I am not a lawyer, but I'm guessing someone who does that and keeps his mouth shut takes a ride and gets an automatic 1- to 6-month license suspension.

If they order you to get out of the vehicle, and you don't, you're probably going to be on the receiving end of a Tazer these days.

Here's what a couple of real lawyers advise, though they're not in Texas:

so, in the interest of not driving intoxicated, or more likely, not letting my friends drive hammered, and really, for my own personal macabre amusement of seeing just how hammered a few of my friends get, I bought a breathalyzer.

IMHO, if someone thinks they need to check their blood alcohol level, they already shouldn't be driving.

Having an Intoxilizer reading below 0.08 is not a get-out-of-jail-free card. It is simply lack of evidence for the prosecution. Someone can have zero alcohol and still be intoxicated by something like pot, LSD, or Xanax.

Some years ago, when cheap Breathalyzers came on the market, some bars installed them. They found that young men were competing to get the highest reading.
