As the name indicates, this is the place for gun-related political discussions. It is not open to other political topics.

Sotomayor reasserts 2nd Amendment doesnt apply to the states

Post by TexasComputerDude »

Mentioned "hunting" and "target practice" as legitimate uses for a gun, as long as the state decides you can have one. Not one word on self-defense.

quote and title shamelessly stolen from freerepublic post and freeper: pabianice

Not a big surprise. At least she's replacing one the 4 we already knew were enemies of the people.

Sotomayor was quite correct in addherring to Second Circuit stare decisis in the Maloney case, and noting the Supreme Court must apply incorporation to the states. I thought she blew a hole in Orin Hatch with all his Second Amendment questions. If anybody didn't get it today, it was Hatch. However, Sotamayor hurt herself beating around the bush instead of putting some of the panel in their place. She did not do so well under the questioning of Jeff Sessions, who pinned her against the wall for the most part. And Fienstein. Feinstein is a train wreck in progress. Congress ought to erect her a clothesline and Feinstein and Pelosi can talk each other into the ground.

I had class most of today, but caught a bit of Sessions questioning. He did a good job.

This woman will be confirmed, unless a bunch of Demos. jump ship, and I don't see this happening. She has no love for guns or gun owners. Mostly the Senate is just going through the motions. :confused5

Senator Coburn (R-OK) is hammering Sotomayor on 2A this morning...Go Senator!!

EDIT: Coburn asked Sotomayor directly..."In your personal opinion, do I have the right to self defense?", and she could not / would not answer the question. She kept referring to State of NY laws, and what they say about self defense. She would not give her personal opinion. Hmmmm...wonder why...

What's next? The 4th and 5th amendments don't apply to the states?

Or the 1st amendment only applies to books and religions that have government approval?
If you can read this, thank a teacher. If it's on the internet, thank a geek.

I am not a lawyer or constitutional scholar but the first amendment does say:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
So yes seems to me the 1st amendment does seems to be restricted to the Federal government (Congress). The 4th and 5th seem more broad. Again I'm no expert and don't know how SCOTUS has interpreted these in the past but its how I read it.
