Would we have won Keller if...?

Post by TEX »

Would we have won Keller if Sotomayer had already been in? We only won by one single solitary little bitty vote!

Yes, Sotomayer is simply replacing a previous no vote. No net gain for the anti's.

Take away the second first, and the first is gone in a second.

Keller? Did you mean Heller?

Yes, the vote would have been exactly the same.

The only difference would be an extra minority dissenting opinion quoting foreign laws, feelings, and that a wise latina can make a better decision.

Vote would have been the same, but there might have been an amicus brief in opposition filed by La Raza.

We know how David Souter voted we only think we know how Sotomayor will vote. Supreme Court Justices have a reputation for not being what we thought they were. There is still hope.

You get enough of them on the bench voting "what's in their heart" instead of what's in the law, and you could lose Heller in a New York minute.

Maybe the "Helen Keller" case. But I haven't seen or heard anything about it lately. ;-)

I agree...For the longest time I was more concerned with they way the question in Heller was framed...That matters to a justice as much as the way they need to apply (in this case) what the Constitution and BOR originally meant...

In my opinion, I thought it could go either way, and in the end it teetered on the edge...I always thought that CJ Roberts was not a lock in our favor in that case, because of the things he said in his confirmation hearing(s)...

Sotomayor will reinforce the left side of that court for at least another 20 years...What we need to hope is that the 4 horsemen on the originalist side of the court stay healthy...For at least another 4, possibly 8 years...If Obama can replace just one of them, we may be in heap big trouble kemosabe...

Obama WILL get two more nominees for sure...I still believe Ginsburg and Stevens will beat feet one way or another very soon...Maybe we can muck up the works with their replacements if we can gain a few seats in the Senate in 2010...That might make our jobs a little easier...

What! :eek6 She said over and over again at her confirmation hearings that she was a supporter of Second Amendment rights???? Surly she would have voted with the majority. On top of that Obama said....
