can this be considered "written notice"

Post by harleyvato »

I was walking into the local FedEx office to mail a package and noticed a sign on the front door stating in both english and spanish:"for the safety of our employees and customers possesion of a handgun under authority of the state concealed handgun permit law is prohibited beyond this point"it had the ghostbuster gun emblem in the center. I realize this is not a 30.06 sign, but does it constitute written notice from a "owner or person with authority"? I went ahead and conducted my business and took a cell phone picture of the sign so I could post the wording exactly.I have done some searching on these forums and read the statutes and I believe this is proper notice. Could anyone offer their opinion on the validity of this sign?If it is valid I will be sending a letter to FedEx asking if this is company policy or only at this particular location and if so telling them why I will never do buisness with their company again.I haave been lurking for some time and recently registered to make this my first post.I am looking forward to the opinions of others with more knowledge.

According to Section 30.06, the sign you saw does not provide proper written notice.
(3) "Written communication" means:
(A) a card or other document on which is written language
identical to the following: "Pursuant to Section 30.06, Penal Code
(trespass by holder of license to carry a concealed handgun), a person
licensed under Subchapter H, Chapter 411, Government Code (concealed
handgun law), may not enter this property with a concealed
handgun"
; or
(B) a sign posted on the property that:
(i) includes the language described by Paragraph (A) in both
English and Spanish;
(ii) appears in contrasting colors with block letters at least
one inch in height; and
(iii) is displayed in a conspicuous manner clearly visible to
the public.
Generally I have noticed that UPS locations are posted with the proper 30.06 sign, but FedEx locations are posted with a non-compliant sign. I choose to do business with FedEx.

Welcome sir to the forum. I just noticed that your OP (opening post) is post number 1 for you.
Where do you hail from? What gun(s) do you carry?

If a posted notice does not exactly match the 30.06 requirements, carry away.

Any sign other than an exactly worded 30.06 is to be ignored by CHL's.

Gunbuster signs and signs that say "The UNLICENSED carrying of guns is forbidden..."
are to make those ignorant of 30.06 think that the store is looking out for them. Ha-ha.

Elsewhere on the forum is the long-running saga of the mall in Early, Texas, which was not
properly posted.

Whatever you do, DO NOT go on any kind of an awareness campaign about 30.06 to stores
which have non-compliant signs. As long as they don't have a proper 30.06, we all can carry
away.

Be vewwy vewwy quiet. Concealed means concealed. My bank and other places with gunbuster
signs are places I carry all the time.

Thanks for the replies, exactly what I was thinking, I had never seen a reference to "concealed hangun liscence holder" so that kind of threw me.I am extremeley quiet about my CHL and also work in the medical field with a professional license that must be renewed every year and the first question on the form is "have you been convicted of a misdeamenor or felony in the last year" so I have no desire to have any legal troubles of any sort(no license no work,e.g. no money  ) I am from Del Rio having moved here from Arizona about 10 years ago.Yes I had an Arizona CWP. I have enjoyed reading on this forum and have seen that the threads and replies are intelligent, pertinent and respectful and am looking forward to being a member here.Again Thanks for your replies. My bet is local management got a wild hair.
What are they going to do should you want to take a box with a handgun in it to be shipped?

I saw your PM first before looking at this thread.

Del Rio is kind of a unique place. I stayed there on my way to Big Bend.

Del Rio has a clearing house for grocery coupons and I understand that this
site has long lines of tables, at which women sort thousands of grocery coupons
that are redeemed from all over the US. Sounds like mind-numbing work, but everyone
needs work.

Del Rio is also the hometown of country singer Radney (That's right, not Rodney) Foster.
"My granddaddy took me on a ride downtown.
He drove an LTD, wore a Stetson hat, and 2-tone cowboy boots."
From the song "Folding Money", a great tune.

Across the river from Del Rio on the Mexican side of the river, "pirate" radio stations in the
1950-1960's era played rock and roll and "race music" (black R & B) when the lily white US
stations wouldn't touch it. These stations had very high power, more than the US FCC would allow
for American stations. The stations were extremely popular and cutting edge. These stations
are enshrined in the ZZ Top song "I heard it on the X", since I believe all Mexican radio station call
letters begin with X. Eventually the Anglo stations in the US started playing rock and roll, and songs
by black artists.

XERB or XERF(forgot which one). Home of Wolf-man Jack! I remember it well. As a kid growing up in the country 25mi. from Wichita Falls, I used to listen to him every night.

When I was growing up in SE Mass, near Boston, I had one of the first
ever transistor radios. It was a little green plastic thing in a brown
leather holder.

I never was able to listen to the X, ZZ Top style, but I could hear the AM
station from Chicago, WLS. It is 986 miles from Chicago to Boston, so it
was quite a thrill to hear such a distant station.

By the way, WLS had a connection with Sears Roebuck. The call letters
were the Sears Roebuck slogan "World's Largest Store."

SIA, I listened to WLS too back then! Wow. To be able to pull in a station way up there was incredible. Thanks for the memories. :tiphat:

I grew up in SE Missouri which was about 500 miles from Chicago, and about 700 from the border. It was in the late 60's, so the X stations had pretty well gone away, but WLS was THE station to listen to for rock and roll. This was prior to the high power FM stations scattered all around the regions.

And back on topic, written notice as stated is ONLY in the form of 30.06, either posted per size guidelines or in something like an employee manual and presented to you for review. :thumbs2:
