Open Carry Business

Post by marksiwel »

I dont want to talk about Open Carry Pro v Con, I just want to know the answer to a question

"PC 46.15: (b) Section 46.02 does not apply to a person who:

(2) is on the person's own premises or premises under the person's control unless the person is an employee or agent of the owner....."

I read that as, I can Open Carry on my Lawn, or if I own a Business, or I can let my employees open carry on my property"

I've heard people say that open carry is illegal even in instances such as these in "Public Areas" its just not enforced, but I've seen Open Carry at Eagle Peak and at the Gun Store in Cedar Park. Legal yes or no?

It doesn't matter if you let them. If it's their premises or premises under their control, they're legal. If it's not their premises or premises under their control, they're not legal to open carry unless they have some other loophole, like being a cop or commissioned security guard. Your permission makes no difference in either case.

I think security HAS to be in uniform.

I can't remember the last time I saw a security guard who was actually armed.

Randolph Brooks Federal Credit Union in Seguin (and I'm guessing their other branches to) has one - in uniform and armed. There's a sign on the door that says so, too. One of these days I'm gonna strike up a conversation with him about what he carries. Real nice guy, just haven't had the chance to do it yet.

So how do gun store employees, like at the Cedar Park Gun Store, carry openly? There are always two guys in there, and one of them is the owner. The other seems to be the "assistant" or something. Is this legal?

This is a good question.
I was wondering the same thing and was going to ask the same question.

The range I did my CHL qualifying at (Ft. Worth - I think it was called Winchester's?) had employees who open carried.

If I control any property and give explicit permission to OC, it seems to me it's legal.

TIWWHLF (This is what we have lawyers for)

BTW I have seen armed security at some apartments complexes in Dallas.

The range I use most of the time ALL employees open carry, as have the emplyees at most ranges and gunships I have frequented regularly.

The same way that non-CHLs are able to take handguns to a gun show: nobody bothers to prosecute, and even if shown the actual law, would just scratch their heads and dismiss it as an oversight.
