If you look at the video ( http://www.cbs.com/primetime/csi_ny/video/ ) at about 37:00 the bad guy shoots one of the victims then his weapon jams. He's obviously trying to rack the slide but is unable to, then gets jumped by the other (soon-to-be) victim and looses the weapon. It then becomes obvious why he's having a problem with the slide as the revolver goes sliding across the floor.
OK, if you have eagle eyes you might have picked up on the fact that it was a revolver when he first fired. I didn't when watching on it TV but went "huh?*" when it slid across the floor.
*Or something like that.

It was a revolver when he started. It was a revolver when he shot. It was a revolver when it slid across the floor. It was a revolver when it was recovered. No wonder he couldn't unjam it. He tried to rack the slide on a revolver. Funny how the sound effect guy added the slide racking sound.
