This cop did everything right. The perp had a .41 Mag that misfired the first shot and wound up DRT.

Wow, that was a great and scary post.

This is what I think happened in the incident:
The cop didn't tell the BG to show him his hands and it
appears that the BG was able to present his .41 to the officer's face.

At about the :31 mark, the perp sticks his gun out the window.
I'm not sure if the gun misfired, or if he was carrying his revolver
on an empty chamber. I thought I heard the click on an empty chamber.

If there had been a good round in the chamber, it looks like the cop
would have been shot in the face.

The cop uses his flashlight/arm to fend off the pistol, and moves backwards
from the driver's door. The perp fires a round, but due to the awkwardness of
firing diagonally backwards over his shoulder, plus being drunk, his shot goes by
the LEO.

The LEO fires very fast and I believe he fired 16 shots, which would indicate a double
stack Glock, or similar. Since it appeared to be a semi-rural area, he didn't have to
worry too much about what was behind his target.

It was this LEO's lucky night. I'm glad he was OK. Good for him.

LUCKY officer....but he should've been more cautious

LEO knew of alcohol and a domestic right before the stop.

DANGER, WILL ROBINSON!

The hammer fell on an empty case. The perp withdrew it, cocked it, and shot again.

14 rnds from a Glock 22, one hit the perp after going through both seat backs

Presenting it to the grand jury and getting a no bill protects the cop and the department from further legal action.

A Glock 22 is chambered in .40. Its standard capacity is 15,
with an optional capacity of 17.

So when the officer fired 14 rounds, he had just about emptied
his gun, given either magazine type.

Does anyone think the BG intended on committing suicide by
cop, or was he just a loose cannon alcoholic who stumbled into
getting himself killed?

Notice the tone of the conversation a split second before he pulls the gun.

He was an enraged (domestic) drunk with a hair trigger.

I think anyone getting "in his face" would've set him off.

From a professional point of view, he was even luckier than you would think. Poor tactics all around the traffic stop, plus he admitted committing one of the ten deadly sins for officers - missing a danger sign. well, he did not really admit it, but the one article posted says he saw the person adjust the mirror so he could track the officer despite the spotlight being aimed on it. He thought it was unusual since most people try to move the mirror away or block it.

People doing things that are unusual and just the opposite of normal is a danger sign. It might be an innocent behavior, but it is clearly not normal so something is up. When you see a danger sign, you do not just walk up to the window. Switch to high security mode, maybe take cover and call the guy out of the truck.


Note: I call this one of the ten deadly sins because it was identified as one of the ten mistakes almost all officers killed in the line of duty made on the incident where they died. The mistakes were identified in the book "Officer Down - Code Three" by Pierce Brooks. Written in the 70's, it is still one of the best police tactical books in my opinion. Unfortunately, it is now out of print and hard to find.

I was on a jury in a murder case once. They wouldn't let us talk about the case until it was done and we were deliberating for a verdict. It took a few hours just for everyone to air out and settle down before we really even discussed it seriously. An hour is not all that much to me.

It was a coroners inquest which may be required under Montana law, I'm only guessing. The cop, by his own admission, said he felt uneasy about the stop. Next time if his gut tells him something is off he'll listen more closely.

I'm not defending the cops who are jerks, but it's stuff like this here that makes some of them that way.
