My coworker got attacked by pitpull

I am a Realtor in Austin, Tx and carry daily. My fellow Realtor (non chl) was showing a house yesterday and as soon as he open the door a pit bull came charging around the corner and sunk its teeth right in my friends leg. I was not there but the struggle went on for a few seconds and my friend (who is a pretty big guy) was able to get the dog off before it could do more damage.

He came back to the office to drop off his client and his pants were ripped up and you could see the teeth gashes in his leg.

I talked briefly with him about CHL. Telling him that he was very lucky and it could have been a lot worse. In a career like Real Estate there are just too many occasions where one is going into a strangers house and has no idea what is behind the door. I think he might be taking his classes very soon...

Thank God the client and my friend ended up OK . The client was just a small girl in college. She could have been seriously injured if the dog had attacked her first...

What occurs to me is, "WHAT THE HECK WAS THE SELLER THINKING, LEAVING A PIT BULL IN A HOUSE WHICH REALTORS ARE SHOWING!!!!"

I'm not one of those that hates the breed, but that there was just plain irresponsible. If I were that realtor, I would suggest to the seller's representative (if it's not him) that their office de-list the house and inform the seller that they will not handle his home until he has made arrangements for the dog to be kept off-site while the house is for sale.

I've got to agree with TAM on this one. It actually doesn't matter WHAT breed of dog...I'm thinking that you have a fairly high risk of the dog attempting to defend its home and pack when a realtor and prospective buyer show up. If the owner isn't home, the home shouldn't show...unless the dog isn't there.

Especially this home, with this dog. He's already proven he will defend his domain, and he seems quite cognizant of the Castle Doctrine.

If it were my home and my dog, I would worry about lawsuits and dangerous animal charges. I don't believe the dog was in the wrong here, but if the right (wrong) person is around when it happens, the owner winds up with a massive spike in his insurance and all the other stipulations that come with owning a dog deemed dangerous by the system. Just doesn't seem worth it to me.

Our Company contacted the listing broker and they were totally unaware of the animal being on the property.

I cant believe how irresponsible some people can be to leave the tiny detail out "there is a dog on property"...not just any dog...pitpull haha...

My buddy just got off the phone with the home owner and found out that THE DOG IS BEHIND ON RABIES SHOTS!!!!!

I smell a law suit in the making...

with TAM. However; I don't know how having a CHL would play out in this scenario. Shooting a homeowner's dog in his own house, just don't where liability would fall on that one. House should def. be unlisted until the dog is crated ormoved from the premises during showings.

What are yalls thoughts on this scenario?

A Realtor (who is given permission to enter the property to show it) is then attacked by a pitbull on the property.

My friend is 6'2...no small cookie and it KNOCKED him to the ground biting him in the upper leg and arm.

To me this would justify shooting animal. Thoughts?

With dogs......shoot first if endangered. In Texas animals are treated as property. Only thing that can be legally recovered is the replacement cost of the dog.

Shooting the dog in this situation could have been dangerous for all party's involved. Your wrestling with a dog on the ground, trying to get to the weapon and then trying to ensure the round will not go through the dog and strike someone else. Then you have the chance that you could injure yourself, should the dog bite the arm you are holding the handgun in possibly shooting yourself. Sounds to me like a good can of OC would have done the job. This is just my opionion but with the dog being on you that fast, i dont think an average shooter could pull weapon, ensure where projectile will end and ingage and stop threat. again this is just my opinion.

I know pit bulls are tougher than lots of dogs, but the nose is a VERY sensitive area on most dogs. If a dog bit me, my first act would be punching the nose. Repeatedly.

Heck, if it works on sharks, surely it'd work on pitbulls, right?

Don't forget time taken off work, loss of pay for that time, and potentially loss of the client! If she stopped her search for a home because she got scared after the attack, that's potential lost revenue due to the attack.

In the future a can of Bear Spray or a club of some sort would probably be more useful against a dog than a CH.
