WA: The family that commits felonies together ... umm ...

On April 19, a homeowner in Onalaska, Washington (middle of nowhere, but between Tacoma and Portland) fatally shot an intruder at his rural home at night.

Today the sheriff department concluded that the homeowner acted in justified self defense and no charges will be filed.

Last week they arrested the wife of the dead man for allegedly participating in the burglary.

The conclusion seems satisfactory, but it took three months.

He fired several shots at the tires of the suspect vehicle to disable it and immediately had two bright lights shining in his face from two separate directions.

According to the investigation, Brady fired towards the lights to protect himself from a perceived threat.

I'm guessing they weren't using Surefires... or didn't know how to use them properly even if they did.

so I wonder if she would / could also be held and tried for murder or as an accessory to such being that her husband was shot and killed as a result of both of there actions. I rember ayoob saying soemthing along these lines in one of his books.

Maybe. It depends upon the specific terms of state law. Most states have laws that make all participants in a criminal act responsible for all the results of that act (kind of like evil Three Musketeers).

However, it does seem like rubbing salt into a wound after she saw her husband killed.

Actually, I don't think it is concluded yet. It was only the Sheriff's Office that decided it was justifiable SD. There's this farther down in the article:

While Mansfield's office (Sheriff] will not seek charges, a report will be forwarded to the Lewis County Prosecutor's Office, which will review it and decide if charges against Brady are warranted, Mansfield said.

More waiting for Brady.

Yeah, but if the prosecutor doesn't "prefer" charges, the grand jury tends to no-bill. My amateur observation of these things indicates that the results of the police investigations make all the difference at the grand-jury level, even if the prosecutor wants to go for blood.
