CHL Rule Changes

:tiphat: I visited with my local gun dealer today who completed his Instructors requirements the first of the month and we chatted about his first class this past Saturday and some of the amazing topics that occur and recur on this forum. Austin (guy's name) indicated that there were several rule and interpretive changes; i.e., 30.06 signage, CHL alcohol consumption, renewal requirements and perhaps others of which I wasn't aware that were presented and discussed in his class.

Wouldn't it be swell if there was a thread that updated us 2008 and earlier licensees of the changes in procedures, rules, laws and requirements since our matriculation? You know a kinda' "sticky thread" that was read only without all of the jailhouse lawyer debates as to meaning and interpretation of the current requirements?

There could have been no recent changes to 30.06 signage or alcohol since the legislature hasn't been in session since 2009. All such changes predate your 2008 class.

Changes about renewal procedures have been documented in recent threads.

There is a section of this forum that gives a status of all CHL Bills introduced during the current legislative session. As Mike1951 pointed out, the last session was 2009.

Maybe some of our instructors that took that class can comment on his perceived changes to 30.06 and alcohol related matters.

Thanks for throwing the life preserver. :tiphat:

Specifically, Austin said the 30.06 sign letter size had been reduced and that his instructors were of the opinion that any alcholol consumed when carrying was not a good idea and would have to be seriously defended should the CC come into play (this is only common sense - if not law).

EDIT:

It just dawned on me that we were on "summer sabbatical" in the Rockies from mid-May through mid-October when most of these posts were memorialized. Oh well...it must be true, I am a dufous.

I attended the June class. No mention of "reduced" letter size of 30.06 (that I recall). However, they did stress exactly what has been discussed here numerous times--- you could be arrested for intoxication for consuming ANY alcohol while carrying under CHL. It might be a local "Bubba Leo", but if in Bubba's opinion your intoxicated then----- off you go----- and no, a breathalizer doesn't even come into play. Not required. You could also be arrested for intoxication if you appeare to be under the influence of prescription drugs etc.
IMHO the Leo's I know personally would not arrest a CHL for having a beer with his Enchilada dinner. However, you may run into a Leo I don't know personally ...... :anamatedbanana

Intoxicated is intoxicated. Same as driving.

Wow! Another expert instructor? How many of them can there be?

My renewal is coming up in 2012. Since the next session is in 2011 I'm already getting worried about how much misinformation there will be at my class. Is it the second or third renewal where the class is exempt? This will be my second renewal.
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

I agree....but... as with many things in life... I have had a personal experience that has been enlightening. I bet others here can say the same. A couple months back, I damaged a nerve in my neck that caused excruciating pain. I have been on a combination of 10mg valium, 300mg gabapentin, 10/500 hydrocodone four times a day now for about 9 weeks. Now this combination would have knocked me on my rear end and made me unable to function three months back. But No.... thanks to the miracles of the human body, I am now functioning like I have no drugs in my system at all. I don't feel any "intoxication" what so ever from these meds at this point. I have known others who are on an even stronger combination of pain meds and function as well as your minister on Sunday morning.

I said all this because I have wondered a few times how this works. No cop or anyone else would ever know I am on these meds unless I told them I was. So.... am I intoxicated? This post isn't meant to be a challenge... please... i don't need judgemental posts at the moment. i am hoping for an answer I can hang my hat on.

By the way... surgery in the next few weeks will result in three to six months on pain killers. Where does a feller or gal :0) stand in this situation? After all... I am not intoxicated technically.

This is not legal advice but I think you aren't intoxicated if your mental and physical abilities really are not adversely affected by your meds. However, if someone has slowed reaction time or reduced coordination or impaired judgment, even if they don't realize it, it's possible they are legally intoxicated according to chapters 46 and 49.
