PCS II

I was informed by Mr. Cotton that I can have a CHL 10 years after my DADJ date(2012). What about carrying a handgun in my car until then?(ex. glove compartment)

If you can legally possess the firearm, and are not a gang member, and are not committing a crime, MPA allows you to have a concealed handgun in your car. IANAL

I don't know how you'd find out if you're allowed to legally posses a firearm. I'm about the most inexperienced person here. But I knew that if you answered no what the answer would be. Unfortunately, it is late and you'll have to wait for a night owl or for the more experienced to come back tomorrow to answer you. I wish I could have been of more help!

He doesn't have a conviction; it was a successfully completed deferred adjudication.

True. But, how do I find out if I'm eligible to purchase and possess a firearm?

A successfully completed deferred adjudication is not a conviction so it does not prohibit you from possessing or buying a firearm.

There is no one to call. Why are you worried that you cannot have a handgun in your car?

I don't want to go to jail for a possession of a firearm if ever caught with it in my car.

I presumed you don't want to go to jail. My question is more specific; what is it in your past that makes you think you are unlike every other Texan who can have a handgun in their car?

It is not illegal to have a handgun in your car unless:
  • 1. It is in plain view;
    2. You are committing a crime other than Class C traffic violations;
    3. You are a member of a criminal street gang as defined in Chp. 71 of the Texas Penal Code; or
    4. You are prohibited by state or federal law from possessing firearms.
Do you fall into category numbers 3 or 4? If not, then what else do you need to feel confident you can legally have a handgun in your car?

I think his issue is that he does not know if his deferred adjudication of a felony causes him to be in category 4 and the responses above have not clearly said that it does not.
