Carrying concealed in someon's home

Post by HoustonSy »

The thread re "Displaying at someone's home?" gave me a headache, but it raised a question for me: I can't find in the regs anything concerning carrying concealed in someone's home.

You can carry as long as the house isn't posted 30.06, you are legally in their home and not committing a crime.

Newbie here, but I also understand if the property owner tells you not to carry then you cannot either.

That is correct. If the property owner gives verbal notice then you may not carry on his property.
If it is written notice it has to conform to the legal language of 30.06.

You are not required in Texas to give notice to a property owner before entering.

If it is written notice it has to conform to the legal language of 30.06.
I thought that on private property, business or non-business, any kind of written notice, like a card handed to you, worded any which way, is adequate for informing you. Wasn't that an amendment that we cried over?

Nope...written notice must conform to the language specified in 30.06. Verbal notice (OK...OK... ORAL) notice has no specified form.

Correct.

Written on a card has to conform to 30.06 in language but not in size letters & in the 2 languages.

Oral can be as simple as "hey dude, no guns llowed in here" to as formal as quoting the statute.

"Concealed" means "Concealed".

If somebody (other than a police officer in line of duty) asks if you're armed, the answer is "No."

If somebody says, "We don't allow guns here", excuse yourself and say you left your cell phone in your car (or something). Then either a) leave or b) lock the gun up in the car.

Easy peasy ;-)

If its really someone's home and I have any reason to think they might have a problem with me carrying a gun in their home, then I'm gonna talk to them about it and respect their wishes (which might well mean that I don't set foot in their home, but I could always suggest they come to my house instead).

Personally, I think it would be extremely rude to do otherwise. I mean, I can legally come into your house (invited of course) and start cursing your religion. Just because I can do that doesn't mean that I ever would.

If someone invites me into their home, they implicitly invite everything I'm wearing and carrying. If they don't allow handguns or car keys or cell phones or boxer shorts, it's up to them to explicitly say so. If their conditions are unacceptable, I won't accept their invitiation, and everyone gets what they wanted.

Suggestion:

Don't accept invites to the homes of folk you don't know. If you know who and what the hosts are before any invitation is accepted, there should be no major problems beyond some social gaffe or other embarrassing mishap.

Great fleas have little fleas upon their backs to bite 'em.
And little fleas have lesser fleas, and so ad infinitum.

So if you invite someone into your house, then you are implicitly inviting the 8 ball of blow that they are bringing with them as well? Some people find guns just as offensive as drugs.
