Getting a haircut
Today is my second time getting a haircut since I started carrying on a daily basis. The first time I didn't need to remove my cover garment but today I did. The barber knows I have my permit.
Now the barber shop is in Lufkin, and the barber as well as most, if not all of the clientele are gun friendly. The barber tends to run off any customer that doesn't agree with his views. It’s really kind of funny when you witness it, but anyway.
So today he had no one in the shop when I came in, so as I pulled off my light jacket and said that I hoped he didn't call the law on me for "intentionally unconcealing". He looked down at my Glock OWB at about 3:30 and said "Naw man, this shop is an open carry shop".
Well the whole time I was in the chair I hoped that no one would come in. I had my jacket in my lap and the way the shop is laid out the waiting area is to the left of the chairs, so all I would have had to do is get out of the chair, side step a step, and put my jacket on. Next time I think I'll pull my shirt out so that the most I'll have to worry about is a little printing.
I pose this question to the forum. Would you do as I did or as I suggest I will do next time? I kept thinking the whole time; "Concealed means concealed".
Also how do you other OWB carriers handle this situation?

I really like your barber. Don't care what your haircut looks like. He rocks.

Yeah he's a good guy. I started going to him when I was on leave from the Navy and my dad went in for a haircut.

All good intentions aside, the barber can't legally give you permission to open carry. You're not in control of the premises, and you don't work for him. I would keep it concealed. Consider that the next customer to come through the door to this place might be a police officer.

Mine stay concealed. I've never told my barber I carry, but I think he suspects. I always have two shirts on and he has never asked me to remove the outer shirt. He is an old Marine and is conservative/liberal.

My barber is gun friendly. He does not know that I carry. He may have guessed it, but I've never told him. I always wear my shirts untucked, regardless of whether I'm carrying OWB or IWB. But usually, I pocket carry a revolver when I go get a haircut because my big a.... er.... butt fits in the chair better if there isn't a gun on my hip. Same for dental appointments.

This.

How can the barber not give you permission to OC inside his own shop?

Welcome to the board. Huuuumm, 69 South just outside the loop headed to Huntington. Shop on the Left. Yep, that would be his response all right. Might need to keep it covered though. As above: he cant legally give you permission to uncover. May never be an issue but there is always the chance a new customer will be in. Also the state barber shop inspector can walk in. One of the Lufkin PD officers used to barber there as a side job too. I know he did quit for a while but could come in too.maxlib wrote:Today is my second time getting a haircut since I started carrying on a daily basis. You really answered your own ? when you said "all the time you kept hoping no one would come in."
My barber knows too. I have one of my flyers on his board. He turns my vest collar down and then puts the neck paper on. He still gives me a straight razer shave too. You are right about probably being able to put your cover garment back on in there w/o anyone seeing. Should be pretty easy since you are not self conscious & not making a big deal out of HIDING something. It would not be my recomendation though.
We need to meet for coffee or soda & a shoot some day. Bring your dad along. Could be we know each other.
PM me w/ a tele # if interested.

Exactly.
My interpretation, which I've seen previously supported here and in my CHL class:
CHL code gives you the authority to carry concealed anywhere that is otherwise not prohibited. A business owner nor homeowner cannot give you the authority to unconceal, unless it is a place you are in control of. To be in control of it, you must be the homeowner or legal resident (hotel, leasee), or the business owner or employee.
PC §46.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE
HOLDER. (a) A license holder commits an offense if the license
holder carries a handgun on or about the license holder's person
under the authority of Subchapter H, Chapter 411, Government Code,
and intentionally fails to conceal the handgun.
If you are not an employee or owner, the premises is not under your control.PC §46.02. UNLAWFUL CARRYING WEAPONS. (a) A person commits
an offense if the person intentionally, knowingly, or recklessly carries
on or about his or her person a handgun, illegal knife, or club if the
person is not:
(1) on the person's own premises or premises under the person's
control; or
(2) inside of or directly en route to a motor vehicle that is owned
by the person or under the person's control.
(a-1) A person commits an offense if the person intentionally, knowingly,
or recklessly carries on or about his or her person a handgun in a
motor vehicle that is owned by the person or under the person's
control at any time in which:
(1) the handgun is in plain view; or
(2) the person is:
(A) engaged in criminal activity, other than a Class C misdemeanor
that is a violation of a law or ordinance regulating traffic;
(B) prohibited by law from possessing a firearm; or
(C) a member of a criminal street gang, as defined by Section
71.01.
(a-2) For purposes of this section, "premises" includes real property

Re: Getting a haircut
I learn new things every day. So can an owner of private property give permission to OC, but just not if there is a business that is open to the public on that private property? The Annoyed Man wrote:Because it isn't your place of employment?flechero wrote:How can the barber not give you permission to OC inside his own shop?
I'm pretty sure that I can allow someone to handle a handgun and otherwise OC in my house, and on my land. Is this correct? If so, then is the distinction in this case solely related to the fact that there is a business operating on that private property which is open to the public?
Do I understand this correctly?
