Yeah, but was he illegal?
They don't address that question.
Too many unanswered questions to know for sure at this point.

True, it's much easier to conceal four 20-rounders (17+3 with Pearce PG-39 baseplate)

I was unaware there was a .40 cal 30 round mag, perhaps he spread the lips and replaced the follower of a 32rd 9mm mag?.....

A police log said Scott wore a .40-caliber Glock handgun with a 30-round magazine in a holster at his hip, as well as two concealed knives and a "pepper grenade."
Standard issue for anyone attending a "Black Friday" Wal-Mart sale :lol:

Florida is not a traditional open carry state.
Open Carry is lawful while engaged in, or going directly to and from, lawful Target Shooting, Hunting, Fishing, and Camping expeditions.


I'm guessing that doesn't cover buying ammo at WallyWorld, unless he camped there last night to get in early on the Black Friday sale?

My uncle and I camped at a BestBuy years ago ...

It would be a stretch, but maybe he was going directly to the range after buying ammo for that 30 round mag.

Of course, it's all speculation at this point, but two things strike me.

1: If he is, indeed, a former Fed then he may have thought he was OK carrying under LEOPA. Though I'm not sure how open carry fits with that.

2: The way the article is written makes it seem like the chain of events in the courtroom was:
(a) Prosecutor tells judge defendant is a multiple felon.
(b) Defendant tells judge "No I'm not, I'm a retired federal agent."
(c) Prosecutor tells judge "Oh, sorry, we were wrong. Some other guy is the multiple felon."
(D) Judge says "Well, I don't care, I got mad at the defendant when the prosecution first said he was a multiple felon and I haven't calmed down yet."

Now, the article may well be less that 100% accurate. But one can't help wondering how things might have panned out if he'd had a better lawyer.

if he is truly a ex-Fed boy with clean record, a wise judge will dismiss the case and advise the defendant to conceal carry.

Common sense tells me that a person should always know the laws of the States they visit, especially when firearms are concerned. Something just does not pass the smell test on this one.....
