I didn't realize they even checked for a shotgun or rifle. Shows how long it's been since I purchased one of those.

The good news is that a NICS denial affects nothing other than your purchase of that weapon at that time. The bad news is that whatever is in the record that caused the denial may affect other things.FoxtrotTangoAlpha10 wrote:How does this affect my rights on my property or MPA?

I was denied last year or the year before.
Figured out that I had a speeding ticket that I had forgotten about an there was a warrant out for me.
Ticket cost about triple what it would have cost had I paid it on time, but I got it cleared up the next day and picked up my pistol the next.

At the store where I worked, if someone was denied, all we did was give them a pamphlet on how to appeal.
But the dealer where I was making the transaction gave me a phone number to call. It was actually the same phone number we called to run the check, but a different option to push when it says "press one for . . . "
The guy who answered the phone looked it up and said "I can't tell you why it was denied." But then he read off a list of reasons one might be denied. It could have been my imagination, but he seemed to sort of lean into it when he read the one about outstanding warrants.

I mentioned that I had a ticket . . . And he was like "Uh-huh, uh-huh." Not really saying, but sort of telling me without telling me, it seemed. And he did say that if I had a warrant, when I got it taken care of to make sure they "take it out of the system." Said that sometimes it could be days, weeks, or even longer before it got flushed out if I didn't ask them to do it.
So I went and paid my fine when they opened the next morning. I asked how long it would take for the warrant to be removed from the system so that I could pass the instant background check to purchase a firearm. She said she was doing that right then and that it would be gone within the hour. I waited until the next day to try to pick up my gun again, just to make sure. It went through that time with no problems.
When a cop buddy of mine came into the store where I was working, I said "Man, you missed a golden opportunity when I saw you yesterday. There was a warrant out for my arest."
He's like "For WHAT?"

I told him and he said he wouldn't have arrested me but he'd have told me I needed to get that taken care of. My coworkers and another regular in the store, always helpful, said "Heck, we'd have paid you to take him."

But Ceasar, the policeman, said it's too much paperwork and that he'd have just told me to get my tail down there and pay the fine.

I once had a delay...not a denial at a Wal-Mart. I had a T/S clearance in the service and no other record.
PS. I was unoffically told by NCIS supervisor that not all people understand how to deal with millitary files.

Depending on your clearance you may have travel restrictions, that may have messed up NICS.

I've known several active duty LEOs who were always rejected by the NICS check. They had to procure a CHL to bypass the check.

The way I heard it, the first person who answers the phone at NICS is a contractor.
This person just looks at a list; if this, then that. Anything outside of the very narrow scope he looks at gets kicked up to his supervisor.
When it has to go up the chain, the next step is to an actual FBI employee who has greater access to your information.
Lots of people with security clearances have those clearances checked frequently, whether or not they know about it.
The NICS phone person can see that your background has been checked multiple times recently but not why. That sends up a red flag and causes a delay.
I'm sure there are parts of that I don't have exactly right, but that's more or less what I heard when I was doing those.
Sometimes if we had a regular customer who we knew held a security clearance and also knew from prior experience that this person usually got delayed (but always eventually approved), when they told us "delay," we could ask for a supervisor and get it changed to "approved" right then. Depended on who you got on the phone whether or not they were flexible enough to work with you.
Sometimes it's just that day, or that time of day. If NICS has problems with their system, everyone gets delayed, meaning that they'll look at it once they have everything working again.
Also, the system can only handle a set number of checks per day. Around the time of the last presidential election, people were buying guns with such frequency it was bogging down the system. Just about every afternoon, it would start giving everyone a "delay,' then they'd be approved the next day and we'd start the cycle again.

similar info from somebody in this system with possible DQ'ing issues. Or you have a record of some type that the operator
does not no how to deal with..ie T/S, Services records etc. In most cases a delay is turned to a "proceed" in 2-3 min,
(if a sup is available to take the request right then and you are cleared) Others that are qued for a sup are cleared within
24-48 hours. This happens during the busy times as stated above...ie Obama fear!
Deny means your a denied from the purchase "do not proceed with the transaction" You have a record entry that is
prohibated from allowing you to purchase a firearm.

I had this issue before getting my CHL and when I didn't put my SS# on the form. My name is an anglo name, but a very uncommon one. (I've never met anyone in my life with my last name who was not family).
Anyway, there is a convicted child sex offender in Nashville with my first, middle, and last name!!
I found it by googling my name the day I was rejected. That dirt bag. Anyway, I went back and re-applied with my Soc Security number and was accepted.
I also did a thorough check of my credit and background to make sure other items of this dirt-bag's past weren't on my record.
Now that I have my CHL, it's a non-issue for buying guns, but I still monitor my credit like a hawk just in case financial or other items pop up!
