If you're talking about Handog it had nothing to do with a PC 30.06 sign. He was charged w/ failure to conceal under 46.035 and the charges were dropped pre-trial, though that doesn't negate the trouble up to that point.

A good attorney should be able to turn one of these "etc"'s into "win a lawsuit for unlawful arrest, false imprisonment, and harrassment, and get more than adequate compensation for all of the above", especially in jurisdictions where the police force has previously been informed that the 30.06 sign in question is not valid.
I get tired of the sentiment that I should avoid lawful activities, because some LEO may arrest me anyway due to their ignorance of the law, or bias against a law. By this line of logic, I am only safe if I stay holed up in my house, lest some LEO arrest me for a variety of things which are not illegal.

FWIW, I think that you're right. There are always forum questions that beg for a test case's resolution. Go for it! We're not talking about any issue that your money, over time, can't cure.

And like carrying a handgun concealed with a CHL (or as a peace officer). Since CHL/PO carry (46.15) is only a defense to prosecution, I don't know how you guys bear the risk of carrying. I guess enough of your hard earned money will handle the combination of anti-CHL cop and DA... After the proverbial "ride", pre-arraignment jail and hearings, I hope you're happy when you finally prove that it is OK to carry with a CHL. Me, I prefer to stay at home under my covers hoping that I don't do anything to attract the attention of the forces of law and order. I'm still sick with worry over the fact that I tore the mattress tag off my bed. Under penalty of law, no less.

...there it is...conceal right and the "issue" won't come up...unless you have an especially guilty-looking face...there were those who told the Patriot Fathers "You're Gonna Get in Trouble"...and here we are...I refuse to live in fear and give up the rights clearly spelled out in the law, just because a LEO or City Attorney might not know what he's doing...they can be educated...62 years old and carried since I was 14...right and wrong...never had a problem...carrying only legally now doesn't make me quiver...instead of the sniping at those who want to excercise ALL of our rights...we ought to be supporting them...the law is not just for US to obey...but also for THEM...the Executive branch of gov't...but that seems to be forgotten these days...
...sometimes we DO have to pay a price for what we believe and to protect our rights...whether in combat, the workplace, or on the streets...but what if everyone was of the "don't want no trouble" mindset???????? That's what those who would oppress us are counting on....I'll finish out my life doing what the law allows...worked well so far...
