Subject: Political questions District Judge.


I live in Burnet, Registered voter and homeowner, retired from working at a law firm over 25 years as a legal Assistant and was accepted to law school, but haven't gone yet. I had planned to go testify before a committee in the Legislature today, but submitted written testimony instead.

Anyway, I know Donna has done wonderful things for our area and noticed you are running for District Judge.

I just had a couple of questions.

How do you feel about:

Texas Penal Code Sec. 1.08. PREEMPTION. No governmental subdivision or agency may enact or enforce a law that makes any conduct covered by this code an offense subject to a criminal penalty. This section shall apply only as long as the law governing the conduct proscribed by this code is legally enforceable.

Local Government Code 229.001, which specifically denies cities the right to regulate Concealed Handgun Licensees while granting cities the right to regulate some use of arms by unlicensed individuals,

Texas PC 30.06 (e) It is an exception to the application of this section that the property on which the license holder carries a handgun is owned or leased by a governmental entity and is not a premises or other place on which the license holder is prohibited from carrying the handgun under Section 46.03 or 46.035.



(Since a "good faith" arrest can NOT be made for anything which is NOT illegal, I hope the officers, sheriffs, Constables are aware of the above, and trained/informed accordingly, so the Governments don't waste money due to a Federal §1983 civil rights lawsuit.)

Just wondering about your thoughts on that so I can let my fellow concealed handgun license holder friends here in the Burnet/Marble Falls and surrounding area know how to vote.

Sorry for the late response.
But I grew up hunting in Texas and have a concealed handgun permit (so does Donna). My only issue is that we are required to get a permit to do what I feel we have a constitutional right to do. But the law is the law.

no problem thanks for the info, I didn't get to check e-mail until late due to House Bill 750 (passed 5 to 3 out of committee to go to the calendar)

making sure he knows that info due to some odd signage here on a Tax office not in a courthouse, and criminal prosecutors who don't know law here and got info too

Well i'd rather hear him say that he won't convict for violations of an unconstitutional law, but it's pretty close.

Agreed, at least he's now been put on notice of references to what the law actually is a little more.
