When I talked the TXDPS CHL Licensing Dept, they told me on issues like this that "But you understand their intent." Sounds like it might depend upon how picky a judge you get or not. I would opt for "they don't want my money."

I wouldn't carry past it as long as the wording is correct. I have carried past the ones at the GVMM the one or two times I've been there in the last 5 years or so.

"Contrasting colors" and "conspicuous manner" are debatable--how light is the color of the wood, does the sign have to be posted directly by the entrance, etc.--and I tend to give the sign the benefit of the doubt in that situation. In terms of the language of the sign, though, the statute is very specific--the written notice must conform exactly to the language in §30.06.
Sec. 30.06. TRESPASS BY HOLDER OF LICENSE TO CARRY CONCEALED HANDGUN.
(c) In this section:
(3) "Written communication" means:
(A) a card or other document on which is written language identical to the following: "Pursuant to Section 30.06, Penal Code (trespass by holder of license to carry a concealed handgun), a person licensed under Subchapter H, Chapter 411, Government Code (concealed handgun law), may not enter this property with a concealed handgun"; or
(B) a sign posted on the property that:(i) includes the language described by Paragraph (A) in both English and Spanish;(ii) appears in contrasting colors with block letters at least one inch in height; and(iii) is displayed in a conspicuous manner clearly visible to the public.

The only time I've been to that mall was to visit their theater. I was surprised to find the theater was NOT posted. :txflag:

When I was there a month ago, we went in through the Off 5th Ave (Sak's Outlet), no sign anywhere. The Children's Place, no sign. JCPenny? No sign. The only time I saw a sign was when I went out a main mall entrance and saw the sign on the wall on the outside. So if I'd not went out of my way to find a sign that is now out of compliance since the wording is wrong, I would have never known. I don't go there hardly ever anyway, went only because the wife wanted to check out a couple of outlets for clothes for the kids. Since the family is with me and I came in and left through doors with NO signs, I will carry, and if I'm arrested for not complying with an incorrect sign I will never see (since I didn't use those doors) then you bet I'll sue the crap out of both GVMM & Grapevine PD. "Intent" doesn't mean squat, the No Guns signs means "intent." It's either wrong, or it's not.

Of course, unless somebody's doing a random check or something else illegal like that, they'll never know I'm carrying....because I have it concealed :thumbs2:

It's been well over a year since I thought about going to AMC 30 (or whatever it is called at GV Mill Mall), but I recall seeing a non-compliant 8.5x11" sheet of paper 30.06 sign, it was pretty well hidden, not sure if it's still there or not. Their high prices, coupled with the non-compliant sign, means that I go to Tinseltown Grapevine.

We would go to Bed Bath and Beyond! I carried each time, but we found Bedford was closer and they have no sign.

Us, too. It is a little further to drive (especially with that mess on 121 these days) but I'm willing to do it. Besides, the parking situation at Tinseltown is better for my wife.

I'd pretty much come to the conclusion that I'm going to take the LCP if I do go back to GVMM. Some alert Grapevine LEO might catch me printing with my IWB but there is no way that the pocket holster for the LCD looks like anything. Several years ago, there were Grapevine LEOs walking in various parts of the mall. The last time that I was there, there wasn't a single one in sight. All the more reason to not go there prepared.

The last time I was there (a year or so ago) the theater was improperly posted. It was on a 8.5x11 inch piece of paper down in the lower right corner of one of the big windows.

As a resident of Grapevine I get the local paper. And, of course, I look at the Police Blotter section for Colleyville and Grapevine. Seems there are ALOT of incidents that happen in the parking lot of GV Mills and the surround area, ie - vehicles broken into, stolen, assault, etc.

I do find it interesting that the GV Police will go on record to a person (ie - to tell Keith B their stance) but they will not (or have not) issue a written stance (ie - on GV Police letterhead). Seems like a lot of posturing/tough talk. I'm curious if anyone has ever been arrested/charged/convicted for 30.06 at GV Mills by Grapevine PD? :tiphat:
