ACOE/Lake Whitney Trip

Hey guys,

My family takes a week trip down to lake whitney every year. Just got my CHL so when we go in July, I was obviously planning on carrying. Then I read about ACOE not honoring CHL's etc. I know Whitney is ACOE lake, so I can't carry on the water(right?). But, we stay at a resort on the lake. Private land. If there is no 30.06 sign then I'm ok to carry in my cabin, and on the land? Maybe even the boat dock? Anyone know?

Don't know about that particular lake but most of the COE lakes have a gate at the access. Once you go thru the gate you are violating the Federal law if you are carrying under CHL.

So, if your cabin is inside the gate (which is where COE control takes over) you cannot carry, even in your car.

The boat dock, gate or no gate, I would consider COE managed land.

The Whitney State Park, is mostly (or all?) on land leased from the ACOE .... so under Texas law you could carry EXECPT it is in fact illegal under Federal Regs....

You can't even have a gun in the car (under the Texas MP?A/Motorist Protection Act Texas Penal Code Sec. 46.02) on ACOE parking lots whether you have a CHL or not.

You could write the district commander and ask for permission if you want documentation, I'd write/call your US Congressman ... to support Representative Bob Gibbs bill

Have you called your U.S Representative to change this and support the House Resolution HR 1865 by Representative Bob Gibbs mentioned above?

3. 36 C.F.R. § 327.13 remains in full force and effect. It will continue to prohibit loaded concealed weapons on Corps properties regardless of the new law and notwithstanding any contrary provisions of State law. It remains Corps policy that we will not honor State-issued concealed weapon permits on our facilities and that District Commanders do not have discretion under 36 C.F.R. § 327.13(a)(4) to create blanket exceptions to this policy. A change of this nature to Corps regulations in 36 C.F.R. Part 327 would require formal rulemaking procedures under the Administrative Procedures Act (5 U.S.C. §§ 551-706).
The above applies not only to prohibit CHLs, but any guns in cars of unlicensed MPA/Motorist Protection Act carriers in their parking areas ... as well as guns in boats under the newly passed HB 25 in "their" waters .... even if it's a State Park on land leased from the USACE.

So, some people thinking they are legal under Texas law... are in fact becoming criminals under Federal Regulation, whether licensed or not.

E-mail/call/FAX your U.S Representative to change this and support the House Resolution HR 1865 by Representative Bob Gibbs. (Before someone "accidentally" becomes a "test case" and not having money to fight the Feds, loses.)

Caution
... Adjacent land owners are allowed to build a fence ... but there may not be a fence ... They are also "allowed to" have free unfenced access to the Government property for pedestrian traffic (Have unlimited pedestrian access to public land except those areas specifically restricted. ) .... Assume if you are close to the lake, you are on Federal ACOE property and if armed, "an armed criminal trespassing on Federal property" The dock and pier and "near" the water are certainly on government land

Thanks everyone. Will definitely be phoning in my support for HR1865.
I did find this on the link RPB posted:

Construct or maintain any structure for human habitation, permanent or temporary, on the flowage easement land.
While private exclusive use of public land is not permitted, property owners adjacent to public lands do have all the same rights and privileges as any other citizen.

Considering they constructed buildings for human habitation, that would lead me to believe that they are on private land outside any government owned or flowage easement property and therefore the ACOE restrictions wouldn't apply there. Also, I have never seen the concrete markers with brass caps, but maybe that's just because I wasn't looking for them. I definitely will this year.

Me either .... and if I'm in my kayak/canoe/boat/watercraft upstream/downstream in Texas River Authority waters ... headed towards the lake ... I'd have to keep getting out to examine shorelines to find boundaries, cause I can't see them 30' under water "rlol"
