ACOE not honoring CHL is going to cost them my boating $$$

Post by tanker1983 »

After serving 23 years in the U.S. Army, it is hard to imagine how the people running these ACOE lakes do not allow Legal Concealed Carry. Here in Central Texas, and around the state in general, there are plenty of lakes where I can be in a postion to defend my family and friends while out on my boat. These places will now exclusively earn my recreational dollars.

I'd encourage you to take it one step further. Voting with your wallet is a great 1st step.
Now, make sure the ACOE *knows* about your decision and why. Send a note.

You can also inform your representatives in Congress.

If the State converts a right into a privilege, the citizen can ignore the license and fee and engage in the right with impunity. -- Shuttleworth v. City of Birmingham

There's a bill in congress, don't know the number, I think the rep is from Ohio, that does to COE property what they did to national parks. If its legal in the state they have to allow it.

Yeah, I"m 11 to 20 miles from LCRA lakes where fishing is slow but I am allowed, so I go to them, 30-35 miles from ACOE lakes ... where the fish are biting, but I'm not allowed to go, even though TPWD stocked them

Asked for an exception for ACOE property..DENIED

Have you called your U.S Representative to change this and support the House Resolution HR 1865 by Representative Bob Gibbs?

3. 36 C.F.R. § 327.13 remains in full force and effect. It will continue to prohibit loaded concealed weapons on Corps properties regardless of the new law and notwithstanding any contrary provisions of State law. It remains Corps policy that we will not honor State-issued concealed weapon permits on our facilities and that District Commanders do not have discretion under 36 C.F.R. § 327.13(a)(4) to create blanket exceptions to this policy. A change of this nature to Corps regulations in 36 C.F.R. Part 327 would require formal rulemaking procedures under the Administrative Procedures Act (5 U.S.C. §§ 551-706).
The above applies not only to prohibit CHLs, but any guns in cars of unlicensed MPA/Motorist Protection Act carriers in their parking areas ... as well as guns in boats under the newly passed HB 25 in "their" waters .... even if it's a State Park on land leased from the USACE.

So, some people thinking they are legal under Texas law... are in fact becoming criminals under Federal Regulation, whether licensed or not.

E-mail/call/FAX your U.S Representative to change this and support the House Resolution HR 1865 by Representative Bob Gibbs. (Before someone "accidentally" becomes a "test case" and not having money to fight the Feds, loses.)

As you pointed out, it is exactly this not my dollars/not going there for our vacation /// affects Interstate Commerce, giving Congress authority to act on it for ACOE RECREATIONAL areas, like they did for National Parks.

It's not much. But it is a start. Attached is the response from Congressman John Carter's office:

Good ;-)

Senator John Connley, and my US Rep "looked into it" for me, as did Governor Perry, and Carter Smith of TPWD

Be sure to ask your Rep John Carter to co-sponsor House Resolution HR 1865 by Representative Bob Gibbs

I was checking into it, and was happy to discover that my rep. was already listed as a cosponsor.

Do you think the Army Corps of Engineers sees a penny of that money?
