Will owing unemployment benefits affect me getting my CHL?

Hi, I was just wondering if owing unemployment benefits would cause my CHL to be denied? Any help would gladly be appreciated.

Not trying to be snippy.... what does that mean, "owing unemployment benefits?" Do you mean "owing unemployment insurance payments" or something like that?

A few years ago, I was fired and applied for unemployment benefits. I was initially approved, then my employer appealed it. TWC then denied my benefits and sent me a letter stating I owe them the benefits payed to me.

Aaaahhhh. That's a good question. I don't think that law specifically mentions that, but alternatively, you might simply approach TWC and see how much it would cost to make this go away. I would imagine that if they were serious about collecting it, they would have come after you by now. That they haven't done so after "a few years" indicates that they aren't that serious. All the same, it's probably better not to leave any unfinished business out there.

Also, TWC might be willing to work out a repayment plan if the amount owed is too large for you to pay off in one lump sum. That way, even if the amount owed would normally be an issue, the fact that you have a repayment plan in place might negate that problem. At least that is how I would approach it. But again, I'm not a lawyer (you'll see that a lot around here :mrgreen: ), so take what I say with a grain of salt.

Since I'm a guessing type person, I would guess owing the State of Texas money back that was wrongfully given to you (even though not your fault originally) that you have not paid back it will probably be an issue.

Depending on "a few years (?) back" and the amount (?) in question, I'd guess it's a non-issue.

No state agency is going to admit it erred to another state agency. Shoot fire, there are state jobs at stake here, man!

The applicable sections would be:
(11) has not been finally determined to be delinquent in the payment of a tax or other money collected by the comptroller, the tax collector of a political subdivision of the state, or any agency or subdivision of the state;
I think owing the unemployment benefits back to the TWC would probably fall under "other money" and "any agency." The question is whether they would consider you "finally determined to be delinquent." The DPS leaves that determination up to the agency that you owe money to. If you can setup a payment plan, that should be enough to qualify for the CHL.

Thanks for the help guys, I am going to call DPS tomorrow and see what they say. I will also call TWC to see what I can do.

I think that the DPS will tell you to call the TWC. I think that the TWC will tell you to pay them. ;-)

Well I sent an email to DPS and asked if owing unemployment overpayments would affect me getting my CHL and I got back this response, "No, that would not affect you getting a concealed handgun license."
