NICS appeal pending

You can't hurry up a bureaucracy no matter how many times you ask. After several telephone inquiries, I emailed NICS requesting additional info on my denial. Their denial was because I am a fugitive from justice. I was hoping they would tell me what jurisdiction they think I am a fugitive of so I could provide documentation that I'm not that guy. Here was my email response, "Your transaction is still waiting to be worked at this time. Voluntary Appeal File (VAF) and appeal cases are processed in the order in which they are received; therefore, I am unable to give you a time-frame on when the VAF/appeal will be completed. Due to the high volume of VAF and appeal applications currently being received as well as the scope and complexity specific to each case, the current processing time for an appeal and/or VAF request is approximately 104 days from the time we received your fingerprint card(s) or documentation."

So I've got another 18 days maybe, approximately, hopefully, if they accept my fingerprints. :waiting: I'm holding onto my CHL-100 until NICS clears me otherwise DPS will deny and I'll be out my application fee. :grumble I thought my name was fairly unique. I feel sorry for all the John Smiths out there.

Most appeals that I have been exposed to have been in the 90 day range...

I know it's hard, but have a little patience, it'll get worked out. Ask them about getting a UPIN, or go get your CHL.

Wow, that stinks. It is hard enough just having to wait when there are no problems, but then to have something like this come up. I guess that the best mentality is that it will get cleared up sooner or later...

Mine took 27 days. Most of that was waiting on stuff to be mailed back and forth. Sent finger prints in, and yep it wasnt me that was currently in prison. Talking to them does no good. They told me I was wanted in several state I had never been. I was in prison for years that there friends at the IRS had taken taxes from me during. Its all a pain to deal with and they dont really care is the attitude you get from them.

And actually if you have nothing on your record send in your CHL application , it took the state of texas less time than it took the FBI to get things straight for me. The finger prints seemed to be all they need and with CHL they will have that.

My appeal took 30 days from the time I mailed to getting approved.

Thanks. I asked DPS about sending in my CHL-100 since I've completed everything else and was told to wait on resolution of my NICS appeal. Some of the NICS customer service reps are nice and will play 20 questions with you trying to help, but they really cannot say anything. Patience...

For what it's worth, I got denied by NICS and then applied for my CHL without going through the appeal process through the DOJ. I've got my CHL in my pocket right now...

NICS appeal complete! 103 days from denial to resolved. The fugitive warrant was pulled Sept. 1. My CHL 100 was received by DPS on Sept. 6. Prints, photo, etc already accepted. Background check of course is pending. It shouldn't be much longer now... There is a 4" XD .45 compact in my future! Hmmm...guess I could get it today and go to the range. :drool:

It is a good feeling being blessed by the Feds on 911 weekend even with all the hassles. :patriot:
