This should be considered a federal civil rights violation.
Should I hold my breath until the Justice Department investigates?
The sooner I get behind, the more time I have to catch up.

Curious what the dept has to say...I'm thinking this isn't the whole story.

Most likely, either mental issues are in the play, or drug addiction.

When I saw the title I thought it was going to be Lakewood area of Dallas, which I'm very near.

I sure am glad it's not a Texas issue. That would have been really bad.

I don't get it. She has guns legally and there is a problem?

They should be giving her back all the guns and a couple of cases of ammoo just to show how sorry they are.

...until that happens, things like this won't stop...official opression would also work...when any branch of government ignores our rights to enforce their will, they need it rammed down their throat...one way or another...too many have died for our rights for us to let them dribble away like sand ...

Ding, ding, Ding! We have a winner. Good call.

This was from the Lakewood PD call log, a little more than half way down the page, listed as call 102610115 and as a personal welfare at 11720 edgewater.

Anyway back to the interesting part of the log. The really telling part is in the description which I shall quote here...
WRITTEN REPORT By: 2P206
would like us to check to see if francesca rice in apt #709
is there. female is entered missing involuntary out of the
va hospital and they have a signed certificate from a
doctor stating she is a danger to herself or others and can
be taken back to the va hospital against her will due to
her mental and emotional status.
Now IANAL but I would seem logical that the police acting in her and the rest of our interests would be allowed to confiscate and retain her weapons until such time as she is judged well enough to have them returned.

On an interesting side note if you ever want to see just how much your local PD does to keep the peace, deal with numbskull residents, and how often they simply give warnings and difuse the situation instead of being hard-nosed ass, read through your local calls logs sometime.

The event listed in the call log happened almost a year ago (Sep 2010). If there was still a problem with this gal, it seems it should have been documented and resolved one way or the other by now. Not so long ago I remember seeing a similar case, where the cops seized someone's guns, had no legal justification to keep holding them, but refused to turn them over to the owner without a court order. That is wrong, and cops should at minimum have to pay for the attorney and court costs to get them back.

The paperwork she filed is a 'replevin', which if I understand my internet-fu is good, means the court has directed the police department to return her property NOW and the final hearing can be done later. Something usually used with car repossessions when someone misses a payment and the loan company wants the car back.
