Conceal Carry in Private Nursing/assisted living fac.

My wife has a CHL and wants to carry everywhere in her holster purse. She is in and out of Hospitals and other places with 30.06 signs but a lot of her business is located inside privately owned nursing homes, assisted livings, and senior living facilities. She noticed that none of theses place post a 30.06 sign. Is she allowed to carry there. I only ask because they are so closely related to other public nurisng facilities.

In a hospital or similar facilities, if there is no valid 30.06 you can carry.

I am certainly not an authority on this subject nor a lawyer, but I disagree with this and readily admit that at best I think it is a gray area as far as the law goes. Charles has stated that even though a school activity may be taking place somewhere, unless the school is in control of that facility it does not meet the requirements for the prohibition of CHLs. I would submit that, although a hospital may be a teaching hospital, the school is not in control of the hospital and therefore, must post 30.06 signs to keep us out. I would further submit for your consideration the situation of a county hospital, such as Parkland in Dallas. Can they even post a legally enforceable 30.06 sign at all? They are a teaching hospital affiliated with UT, but I suspect like UTMB, they are first and foremost a hospital. The schools do not own nor are they a part of the hospital. They merely have affiliations with them. Is that affiliation enough? I don't know. When I was in school I did several rotations at a few different DFW area hospitals. All were considered teaching hospitals and the only differences from them and Parkland is that they are not physically attached to UTSWMC and they are not county hospitals.

However, to the OP, I agree that she can carry away in the facilities that are not posted and be extremely mindful of her purse. If I were a lady CHLer I wouldn't want to leave my purse somewhere for a co-worker to find only to have them look inside to figure out whose purse it was to discover my PDA. :shock:

I agree it may be a gray area, but anything with the name "University of Texas..." (anything, including Medical Branch), tells me its a school, and therefore off limits until they pass Campus Carry.
But thats just me, I am not willing to test that case what-so-ever, as I think its a losing case.

:iagree: And I was unfamiliar with UTMB being University of Texas Medical Branch. The UT part was easy enough, but didn't realize this was the hospital. I thought this was just the school and you were referring to another hospital that was affiliated with it.

Parkland and all the other hospitals I can think of up here do not have a school's name in it's name. I went to UTSWMC, University of Texas Southwestern Medical Center, but Parkland is still just Parkland Hospital.

I think UTMB is a university run hospital, but I'm not for certain. Here in Lubbock, I used to work at University Medical Center. School-sounding name, but it was not owned, run, or controlled by the Texas Tech University system. So sometimes the name is just that. UMC works closely with TTUHSC in that a lot of physicians from TTUHSC make rounds there, but the hospital itself is a county hospital and run independently. That said, it was 30.06 posted at the main hospital (or it used to be...haven't checked in a while).
