Not at all. It happens all the time, especially out here in Commiefornia.

I loved it when clients came in like that, as long as they had the money to play Remember the Alamo. "Victory, or death!"

Most of them, by amazing coincidence, were direct descendents of Balaam's Ass. But they had rights, and we did the best we could to protect and preserve them, often at great cost.

It reminds me of a cartoon I used to keep under the glass on my desk. It showed a fellow being strapped in the electric chair, and his lawyer hovering nearby, "Why don't you just pay the $2!" :lol:

...the opinion didn't matter, then, as long as it didn't get in the way of the objective you were achieving for your client...it's kinda the same 'round here...opinions are just that...

I think the answer to the OP was posted in the second post of this thread so I will just relate a similar story. I was heading into a Wally World a few months back at around 1am or so. There was a commotion going on in front of the store. Three employees,(I don't know if they were security or not), had a brawl going on with a thug looking dude and his very rough looking girlfriend/wife. There was screaming back and forth going on and the thug dude started heaving stuff at the employees. From the shouting going on I figured out it was a confrontation about theft. The employees were accusing the thugs of stealing and the thugs were getting mean about it. The thugs sped off, almost taking out a few cars and the employees went back inside, all puffed up like real tough guys. I picked the ring leader(or at least the one who appeared to be the ring leader) and thanked him for risking mine and the other customers safety by challenging a thug to a brawl in front of the store. I told him it had to be the single dumbest thing I have ever watched a walmart employee do and told him he should have just called a cop. I ask him what his plans were if the thugs had pulled out a weapon and started firing. He had no answer. Dumb, dumb, dumb!!! All over a pair of jeans! I am surprised Walmart would want the employees doing anything more than requesting a person submit to a search. An employee of walmart trying to physically restrain a thug/thief is just stupid at any level!

I am not saying the OP did this (he didn't) I'm just riding in on the thread....

It's often difficult to REALLY know what is going on, even when we think we do, when it's not our fight.

Absolutely True! It makes getting involved a very serious decision... and risky at the same time.

I did not get involved in the Wal Mart incident in any way. I was a bystander nothing more
Getting involved can turn serious real fast
A few $$$ worth of merchandise is not worth a shooting
The store guards managed to force the thief into a security office
No job is worth getting killed over or getting a serious injury
you can get another job you can't get another body.
The store guards should have backed off.
If they could not stop a petty thief peacfully


The purpose of the forum seems to be to exchange info

Ask a ?? and you get called trigger happy or worse

You are defeating the purpose by bashing

...everyone must have their excercise, though...even if it's jumping on a poster...get used to it, it's part of the game... ;-)

I don't think wgoforth was casting stones and can assure you I was not! My story was similar to yours in that I was a witness to store employees going to far(in my opinion) when trying to recover stolen goods. My second post agreeing with wgoforth was not an accusation that you got involved. I think we were both just taking the opportunity to mention the risks of getting involved... which is what I thought was the point of your post asking at what point you could get involved.

The quote above is your question, correct? Have you read PC 9.31, PC 9.32, and PC 9.33? Whether you are protecting yourself (9.31 & 9.32), or another person (9.33), your answer is found there.

I read the law on this. It looks like using a gun under the circumstances would only
be justified to protect innocent people near by if the thief had produced a weapon
and was an imminent threat to others. No way to justify if a stray round hit a bystander.

I'm not a lawyer please check this out for yourself

Maybe I'm missing your point. You said, "if the thief had produced a weapon." Are you saying the production of a weapon is not an imminent threat to either you or the people trying to restrain him? Didn't know you were looking for an answer from a lawyer. I'm not one either.
