Carrying at a running trail by a lake during college class

Post by F4injected »

I tried to do a search but It seems that I don't have the right key words...

Well anyway, to give you some background, I am taking a college kinesiology running class and we meet at a trail by a lake where we run each time we meet.
We literally just warmup and are given distances to run, then we run.

I am wondering if a licensed chl holder would be able to legally carry his/her handgun in this situation.

As of now, I would think that yes, he/she is legally able to because this is not on a school premises.
Am I wrong?

Thanks!

Also, I can't seem to find the link to subscribe to thread to get email notifications on replies. Does anyone know how to do this? THANKS! :tiphat:

I disagree, simly because it is a college sponsored activity, a college class, and your a student of that class. I would classify it under "College Sports."

May not be right on this one--but I wouldn't want to be the guinie pig. I see ways around it though, like you said... it's not on college property.

To me it sounds like a 'school sponsored activity'.
PC §46.03. PLACES WEAPONS PROHIBITED. (a) A person commits an offense if the person intentionally, knowingly, or recklessly possesses or goes with a firearm, illegal knife, club, or prohibited weapon listed in Section 46.05(a):
(1) on the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or educational institution, whether the school or educational institution is public or private, unless pursuant to written regulations or written authorization of the institution;
No State shall convert a liberty into a privilege, license it, and charge a fee therefor. -- Murdock v. Pennsylvania
If the State converts a right into a privilege, the citizen can ignore the license and fee and engage in the right with impunity. -- Shuttleworth v. City of Birmingham

So....otherwise law-abiding CHL'ers having nothing to do with the class and entirely unaware that it is going on at the park would also not be able to legally carry since the park becomes the grounds of a school-sponsored activity? What about the actual grounds of a school where actual "school" is taking place? All I've ever heard says that we can carry on the grounds under Texas law as long as you don't enter the building.

If I am running at the lake and your class comes running by me I have no more violated the law than if I went to zoo at the same time a class of students happen to go.
Now if I go to the campus track and sit in the stands to watch the team, I should leave the gun in the car.
In your case I would probably leave the gun in the car.

It isn't so much that it's a sponsored activity, but that you are in a school sponsored class....

If this lake is on ACOE property, than it's a Federal NO NO for sure.

46.03 says "any grounds or building on which an activity sponsored by a school or educational institution is being conducted"

No, this lake is owned and operated by the city it's in and the LCRA, which I know allows chl holders on their land.

Btw, what is ACOE?
