States use of force power point

Post by creitsma »

I started using the Use of force power point available on the DPS website...On the slide talking about "factors in determining the use of force" it list "race" as a factor in determining the use of force...Ummmm...That sounds like it can get someone in a lot of trouble, i mean is that right? In my opinion they made a mistake and "race" should not be a factor in determining the use of force

Maybe they meant if your attacker is the same race, you can use force sooner because bigots wont be playing the race card.

In the instructor class last August, when they got to that slide, they specifically said yes race is often a factor in forming a persons perceptions to justify use of force. Regardless of right or wrong, many people, even unconsciously will take race into consideration.

Remember, these are only factors that form the actors own perceptions on whether to use force/deadly force. It still has to meet the "reasonableness" test as determined by the DA/Grand Jury/Jury to be found justified.
