Richardson Wildflower Festival

Post by Commander »

We're planning on going to the Richardson Wildflower Festival tonight. On their FAQ page it says that weapons are not permitted. This is a festival sponsored and put on by the City of Richardson and takes place on city streets as well as the Richardson Convention Center and various parking lots. Can they prohibit CHLs from carrying? Does anyone know if they have 30.06 signs at the entrance.? Would they be valid? Also it sounds like people entering are subject to being searched. Anyone here attended this?

Here is a reply I received from the Richardson Police Department (site of the Wildflower Festival)

We will not be allowing CHL holders to carry a firearm into a festival. Thank you for your inquiry.

Captain Rick Helfers,
Richardson Police Department

I'm not sure how to challenge this, but it seems that it is a violation of 30.06(2)(e).

if the facility is government owned, carry away
if the facility is private, a case could be made that YOU have been given notice, and need to follow it.
However for anyone else attending, if it is a private facility, it needs to be PROPERLY 30.06 posted to prevent carry, or someone needs to give you oral notice upon entering.

What I can say is never ask the facility what they mean, they will almost always answer you canNOT carry.

Also,
if you try to carry, and they try to prevent you, ask for what authority they have to override Texas law and then ask to speak to a supervisor

If only to complain to their superiors, as well as the city attorney, afterwards - get names and badge numbers.

This event is being held on public streets, the Richardson Convention center and on the parking lot of a bank.
I asked the Captain by return email why section 30.06(2)(e) did not apply. He has not
Replied as of yet. I'm thinking about contacting the Chief next week to ask him for the section of the
Law that permits them to ban CHLs on public property.

I hesitate to "carry away" since I've already been told that CHLs are not permited. I'm not
Ready to be a test case by being arrested.

you might remind them that you can carry at the State Fair, and also at Mardi Gras in Galveston, so what makes them so above the rest?

Same problem exists in grapevine. While the individual stores can post (but aren't) the whole of main street is posted 30.06. Not right, I think we are agreed, yet there it is and I certainly chickened out for being the test case.
