Texas Parks and Wildlife Building

Post by pt145ss »

I tried searching the forum but not much luck. All searches returned many hits but none seemed to be relative.

I talked to a Parks and Wildlife Hunter’s Safety course instructor on Friday about taking the course. During his spiel about what to bring and etc. he mentioned “No guns no ammo, period.” I regretfully asked “What about those that has a CHL?” He proceeded to tell me that that he believes it is statutorly off limits because the building is owned by Texas Parks and Wildlife. He then said something to the effect, besides we don’t want anyone shooting themselves during a hunter’s safety course… It just would not look good. He then said, you must leave it in the car.

I believe he said the location is 1340 Airport Commerce Rd, Building 6, Austin, TX.

I thought State Government Buildings could not be posted, except when a governmental meeting was on going, or some sort of court was being held? Is it possible that the building is off limits for some other reason? Is there a way to confirm that the building is state owned? Should I be concerned about safely carrying during the Hunter’s course… E.G. is there something I will be required to do physically that might make pocket carry unsafe? Because he told me no CHL, is that effective notice… and can he give effective notice for a State Building?

Thanks.

Doesn't sound like it is officially off limits, so concealed is concealed.

they may not "want" guns or ammo, but they are really talking about hunting tools, rather than protection tools.

he believes
I knew a guy who believes we evolved from monkeys which evolved from fish which evolved from a fungusy slimy seaweed ...

He also is incorrect.

IF building is owned by Texas Parks and Wildlife

can he give effective notice for a State Building?
Sec. 30.06 notice
http://www.statutes.legis.state.tx.us/D ... /PE.30.htm" onclick="window.open(this.href);return false;
(e) It is an exception to the application of this section that the property on which the license holder carries a handgun is owned or leased by a governmental entity and is not a premises or other place on which the license holder is prohibited from carrying the handgun under Section 46.03 or 46.035.

So, if 46.03 or 46.035 don't list it ... 30.06 does not apply

46.03 or 46.035
http://www.statutes.legis.state.tx.us/d ... /PE.46.htm" onclick="window.open(this.href);return false;
Sec. 46.03. PLACES WEAPONS PROHIBITED.
(1) on the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or educational institution, whether the school or educational institution is public or private, unless pursuant to written regulations or written authorization of the institution;

(2) on the premises of a polling place on the day of an election or while early voting is in progress;

(3) on the premises of any government court or offices utilized by the court, unless pursuant to written regulations or written authorization of the court;

(4) on the premises of a racetrack;

(5) in or into a secured area of an airport; or

(6) within 1,000 feet of premises the location of which is designated by the Texas Department of Criminal Justice as a place of execution

etc

Sec. 46.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE HOLDER.
Still at http://www.statutes.legis.state.tx.us/D ... /PE.30.htm" onclick="window.open(this.href);return false;
Now, if he believes there is a "governmental meeting" going on ...

(i) Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06.
I see no statutory ability to prohibit you carrying there under your CHL unless there's a governmental meeting and a 30.06 sign posted during the meeting ... ;-)

TEll that instructor thanks but no thanks and take your class elsewhere. Randy Hughes - who teaches at the Academy is Cedar Park - is a great instructor.
