LOS LUNAS, N.M. (AP) - A Marine from Belen arrested for shooting and killing a burglar on the Fourth of July three years ago is now going after the lawmen who put him behind bars.

KRQE-TV reports (http://bit.ly/L071LP" onclick="window.open(this.href);return false;) that Luke Sanchez filed a lawsuit this week against the Valencia County's Sheriff Department. Sanchez was charged with ... murder after shooting a burglar

Sanchez said he shot in self-defense

He was later cleared of all charges.

The lawsuit claims three lawmen,...violated his civil rights.

I don't think he's going to win. It'll be interesting if he does. Maybe he should win, but it wont be easy.

If he was denied water and force to drink from a toilet instead, I hope he becomes a millionaire. There is no excuse for that kind of treatment, no matter how heinous the crime and especially if it it was a questionable charge in the first place.

I wasn't thinking about those parts since he was going after the officer that arrested him and the two that told that officer to arrest him. Other than putting in jail, I didn't think they were responsible for that treatment. That would be the jailers and it didn't say he was going after them.

I have worked on many similar cases. Unfortunately he will face hurdles such as governmental tort claims limits and procedures, insurance issues, and years of litigation.
