felony question

Post by Venus Pax »

Is anyone (especially those of you in law/law enforcement) familiar with the term "filed without a verdict"? If so, what exactly does it mean? It pertains to a felony conviction.

I don't know the correct answer; I'm sure someone with more knowledge will chime in.

A quick internet search didn't turn up much, but in the one case I saw, it seemed to be something like a deferred sentence or judgement....something in the information I saw stipulated that the defendant must stay out of trouble for 1 year or some such time frame.

If there is now verdict, how can there be a conviction? :headscratch

That was my question as well. Someone asked me this not long ago, and I was trying to figure out if they just were mixed up or if this was even possible. They're trying to find out if a friend can get a CHL.

Perhaps they meant "filed without a finding" or "continued without a finding" which seems to be a disposition similar to deferred adjudication in parts of Yankee Land.

You understood that I meant "no verdict" not "now verdict." Too me, it means that felony charges were filed, but there has been no trial or anything yet or someone messed up and just plain forgot to dismiss them.

How old is the case? If old - nobody updateted that CCH record, and you need to contact the court for a final disposition. If recent, the subject is likely under indictment awaiting trial. It could be anything in between as well. CCHs are weird like that.
