Self Defense?

Post by smoothoperator »

A motorcycle hits 4 year old girl.
The girl's father attacks the motorcyclist.
The motorcyclist shoots the girl's father.

Self defense?

Let's pretend it's hypothetical although a news search will find a similar actual event.

Self defense? Yes, I believe so.
Will he get off on self defense, probably, but he will be charged with the hit on the girl most likely

I read this a day or two ago and if the little girl really was on the loose and darted out into the street there's nothing the biker could have done. This happens to a lot of people and they are never charged.

Read about this the other day. Child runs out into traffic, off duty cop tires to do everything he can to not hit her, breaking several of his bones in the process. Dad comes out and instead of seeing to his injured daughter starts to attack the man trying to give her aid. The officer appears to have tried to get him to stop his assault several times before he was forced to shoot the man. Terrible of course, but if it had been my child hit I would have been too busy trying to help her to stop and attack anyone. Additionally I would have been terrified that I would be brought up on child neglect charges for losing grip of my childs hand as it seems anytime a child is injured someone gets that charge slapped on them.

It depends who you ask. The people who said Mr. Zimmerman acted in self defense should say the motorcyclist acted in self defense. On the other hand, the people who said Mr. Martin was justified in beating Mr. Zimmerman for following him should also say the father was justified in beating the motorcyclist for injuring his daughter, and therefore the shooting to stop the beating was not self defense.
