Drivers licensce question
I have a guy that took my CHL class this weekend and did not know till the end of the class that he has been in texas over 6mos (the requirement to establish resident in TX) but his DL if rom illinois , I asked him that i didnt want to issue the CHL-100 until i could contact DPS (sat on phone 45+ and no answer) so i wanted to know anyone run into this and what did ya'll do about it

First off, the 6 month residency period is no longer in effect. Second, IMO he needs to get his Texas DL ASAP and then he can apply for his CHL. He is over the statute for changing his DL.

Thanks that is what i pretty much told him , i just wanted to makke sure i was in the same ball park.... I agree i told him to go get his TX DL pretty quick then apply for the CHL afterwards

Keith: So, what does he do about the class/CHL-100. Since the DL # is on the CHL-100, Texanaggie would have to wait to issue the CHL-100 until the student has his Texas DL If he does so, the date of the class will show the class was taken before the license was issued. If the student still has the Illinois address (doubtful), the CHL-100 could be issued against the Ill. Seems like a small can-o-worms to me. Perhaps an email to DPS describing the situation would clear it up. (And perhaps not...)

Can one issue a CHL with the temporary DL? is there a waiting time between getting your DL and CHL?
I only ask because he might be able to get his DL issued online, print out the temporary one, and then apply for his CHL once he has the (audit?) number.

Why does it matter to the instructor? Record the ID he provides on the CHL-100 and the rest is between him and DPS. When he provides work and residence history, I'm sure DPS is qualfied to make that decision without our help.

And who is the student going to come back to when DPS rejects his application (and keeps his application fee) because the CHL-100 didn't match his new Texas Drivers License? I didn't say not to warn him but an instructor certificate is not commisioner Gordon license.

I always ask for DL or state issued ID before the class starts. Saves a lot of time and keeps surprises like this from happening.

The mailing address can be different from the physical address. So, he could apply with the IL DL, and still have it mailed to his Texas address.
And, recaffienation, it is not about TX CHL Instructors thinking they have the power to approve or deny a license. The problem is, instructors have to answer to DPS about accuracy of records, especially the CHL-100. Not only can you lose your instructor certificate for falsifying documents, you can also be prosecuted.
And, since I am not willing to take that risk, I would put the IL DL on the CHL-100. That is the ID he presented when he took the class. Everything else is between him and DPS.

ok here is what DPS told me....
The student may apply for the CHL license as a non resident until he receives his DL license. Please note that legally the student who has moved must update their DL within 90 days of moving.
yes i did give him the chl-100 and i also infromed him what could happen and he understood and was going to change it ,,,,,,,,,,,
