Question about current CHL holder

Post by JustMe »

This has probably been covered, but I can't find it.

What do you do when you encounter a person with a CHL that has absolutely the WRONG attitude about the CHL--about what they will do-overly aggressive-berating others for first seeking other alternatives, brags about how time they have pulled their gun on someone, etc.....

I know as an instructor, if a person in my class had those attitudes & behaviours, I would be writing a letter to DPS explaining everything and allow them to investigate whether that person should be issues a CHL.

But----just as a general rule, is there anything we can--or are responsible -to do when we encounter such a person

Thanks

You can refund their money and kick them out of you class.

If you witness them committing a crime, you can report them to the cops. However, if you just don't like their attitde but they're not doing anything illegal, that's not enough to suspend or revoke their license.

As just another CHL holder if I ever come across someone like that I'll do my best to stay as far away from them as I can. I don't want to anywhere near them when they implode.

GC 411.188 HANDGUN PROFICIENCY REQUIREMENT
(k)  A qualified handgun instructor may submit to the department a written recommendation for disapproval of the application for a license, renewal, or modification of a license, accompanied by an affidavit stating personal knowledge or naming persons with personal knowledge of facts that lead the instructor to believe that an applicant does not possess the required handgun proficiency.  The department may use a written recommendation submitted under this subsection as the basis for denial of a license only if the department determines that the recommendation is made in good faith and is supported by a preponderance of the evidence.  The department shall make a determination under this subsection not later than the 45th day after the date the department receives the written recommendation.  The 60-day period in which the department must take action under Section 411.177(b) is extended one day for each day a determination is pending under this subsection.

But that's just about handgun proficiency. That doesn't say anything about the person thinking that they have a Batman license.

Right--if they are in my class, I can do that.

I was talking more about someone who already has a CHL, and exhibits behavior that would lead you to believe that they don't have the neccesary attitude(which is part of proficiency) to be a licensee

For now, I will just avoid like the plague!

Sorry thought your OP said person was a renewal student - cited statute applies to new and renewal licenses.

As for someone already approved who you just meet outside a classroom, short of them threatening a criminal offense, not much you can do but avoid.
