Interesting and disturbing that she would have an exemption from the Federal GFSZ, but not NC's own laws.Keith B wrote:NC law does not allow a CHL to carry on school property and it is a Class 1 Felony if you do. I wonder if NC has a law similar to our "Necessity" or a conflicting harms law. Basically, violating a law is justified to avoid a greater harm than is prohibited by the broken law.

Maybe, but in this case she didn't need it. It was nice that she had it in case she needed it and maybe she would not have been arrested if she had actually used it.MasterOfNone wrote:I wonder if NC has a law similar to our "Necessity" or a conflicting harms law. What, was she supposed to toss her gun out the window into the playground before she pulled into the parking lot?C-dub wrote:Maybe, but in this case she didn't need it. I am not a lawyer, nor have I played one on TV, nor did I stay at a Holiday Inn Express last night, nor should anything I say be taken as legal advice. If it is important that any information be accurate, do not use me as the only source.

No. She wasn't supposed to have gone onto school property with a gun. I would expect the same outcome if someone ran into a school while CCing to report that they were being followed. That she was being followed has not been confirmed. How many times have any of us thought we were being followed only to have it turn out that we were not and the other person just happened to be going in the same general vicinity as you or it turned out to be one of your neighbor's?Dave2 wrote:What, was she supposed to toss her gun out the window into the playground before she pulled into the parking lot?C-dub wrote:Maybe, but in this case she didn't need it. I do hope that she can convince the judge that she really was afraid and thought someone was following her and they will drop the charges or find her not guilty.
