45-year-old Pat Mahaney is back home after being hospitalized for four days with internal injuries and bleeding, cuts and bruises. Police in the northern Cincinnati suburb of North College Hill say he was found covered in blood last Saturday evening.

Witnesses reported he was "jumped by six children."
When police rounded most of the teens up ... they said they attacked the victim, identified as Pat Mahaney, because "they were just bored and were looking for something to do," the report states.

They also admitted he had done nothing to provoke being kicked and punched repeatedly in the face while he was helpless on the ground.
Had any of these wayward youths been shot and killed we would have heard "but he was turning his life around/ he was a good boy". It could almost be a drinking game with these news stories. I read where a 14 year old stole a car and the parent said it was the driver's fault and that people shouldn't leave cars unattended or some other nonsense.

The egg donor of two of the assailants said they are really good boys: :roll:
"They were sorry, not only because they got in trouble (but) because they're not bad people," said Latasha Alford, whose twin sons were charged in the attack. "They have good hearts; they're really good boys."

The police say they are not remorseful:
Police were more struck at how cocky the boys were for being so young.

“They were pretty arrogant in the interview with us,” Foust said. “It’s appalling. I think it’s despicable. This appears to be premeditated and there was no remorse on behalf of any of the assailants. Thirteen-year-olds ought to be playing basketball, not running the streets looking for ways to entertain themselves at the expense of somebody.”

All that said, after all the GZ/TM uproar, can you imagine the public lynching that would occur to the person who met this disparity of force by piling up dead bodies of 13 and 14 year-old feral predators?

Just remember, any time someone from a proper Democrat Party "protected voting block" does something wrong, it is automatically "society's fault" (conservatives fault) for not "sharing the wealth". I have absolutely ZERO against anyone due to race, ethnicity or national origin, having served in the USAF with a lot of great folks from a lot of places and backgrounds. But I DESPISE condoning bad behavior by using that as an excuse.

There is no excuse for inexcusable behavior...regardless of ethnicity or age. If society (?) deems these animals to young to punish, then haul the parent/s before the bar and make them accountable.

Not surprised. I once saw a 13ish year old boy PUNCH his mother in Walmart. Right in the gut. I was surprised. I asked if she needed help, she told me she had it under control.

A grand jury indicted the group of 13- and 14-year-old boys on one count each of felonious assault and aggravated rioting.

The Hamilton County Prosecutor's Office is recommending to the court that the boys be designated as "serious youthful offenders," meaning that if convicted, they could be subject to time in adult prison if they aren't successful in the juvenile system.

"It is a very serious case and we thought it was appropriate to seek this possible sanction," said Julie Wilson, a spokeswoman with the prosecutor's office.
Mahaney was hospitalized for four days.

The teens' next court appearance is Tuesday, when a trial date is expected to be set. Two of the teens posted bond, while four of them remain in custody.

The beating shook the quiet, blue-collar suburb of North College Hill and led a white supremacist group to hold a rally along one of its main drags last week, calling the beating a hate crime; Mahaney is white and the teens are black.

Unless there's some kind of hard proof that it was, then it shouldn't be considered a motive. The same thing should be true if the races were reverses. You can't be mad when they infer the white guy was racially motivated with no evidence, then yourself make the same inane logical jump that it was racially motivated when they're black. It just makes you sound as silly as they are.

A sociopath who would attack anybody at random is more dangerous to society than somebody who only attacks green haired people. Why should the indiscriminate sociopath get a lighter sentence than the green hair hater?

Do you not agree with first degree murder vs. capital murder either? Is an on duty police officer's life more valuable than if he was off duty? Hate crimes can be murky. But punishments are meant to deter. Statistics show that when executions are up, heinous crime rates drop the following year. I want Black, White, Other supremacist organizations (individuals) to know when they seek to injury the others they openly despise, the charges will be trumped.

I'd like to see this death penalty study you're citing. As much as it pains me, I've never seen one with with a data set that showed statistically significant change. I've also never seen one that had a statistical difference in number of people executed from year to year. The death penalty would be a great deterrent if we ever actually used it. But in all honesty, it's rare and people sit on death row forever. I'm tired of paying for their meals and lawyers .Steven Levitt has some very nice analysis on it actually.

As for the murder question, no I mainly don't agree in differentiating. With the except for the provision of killing multiple individuals, I see no difference between my life, a judges life, or a police officers life. I'm a software developer, the world needs us too.

I absolutely believe there is a deterrent effect.

In the study GETTING OFF DEATH ROW: COMMUTED SENTENCES AND THE DETERRENT EFFECT OF CAPITAL PUNISHMENT from The Journal of Law & Economics at the University of Chicago Law School, there was a definite deterrent effect found. From the abstract:
This paper merges a state-level panel data set that includes crime and deterrence measures and state characteristics with information on all death sentences handed out in the United States between 1977 and 1997. Because the exact month and year of each execution and removal from death row can be identified, they are matched with state-level criminal activity in the relevant time frame. Controlling for a variety of state characteristics, the paper investigates the impact of the execution rate, commutation and removal rates, homicide arrest rate, sentencing rate, imprisonment rate, and prison death rate on the rate of homicide. The results show that each additional execution decreases homicides by about five, and each additional commutation increases homicides by the same amount, while an additional removal from death row generates one additional murder.
Really pause to think about this for a moment:
  • Each execution prevents 5 murders from occurring.
  • Each commutation increases murders by 5.
  • Removal from death row to life in prison increases murders by 1.
The study shows that deterrent effect even when these people are sitting in prison for 8-10-15 years before being executed. I have to believe that cutting the wait time down to 6 months and performing the executions publicly would both serve to increase the deterrent effect on the number of homicides prevented. I am all for going back to public hangings in the town square.
