Got my new CHL permit after an address change. Now what?

I'm a little lost as to what I need to do with my old (now incorrect) CHL permit. I had to do a change of address a couple weeks ago, so I got my new, current card. Am I supposed to send the old one back to them or simply just destroy it like you would do when you get a new/updated driver's license? The new card didn't come with any info regarding this. Sorry for the noob question, but I'm a little lost here. Just want to make sure I don't screw something up. Thanks in advance for your help.

On receipt of a modified license, the license holder shall return the previously issued license to the department.


This is in your CHL16 that you should have recieved in class. They will suspend your license if you don't send the old one back in.

If you didn't get a copy of the CHL16, I suggest printing one out and keeping it in your glove box.

Look on page 21, at the reasons for suspending a license. One of the reasons is failure to return your license persuant to Section 411.184(d)

Modification

(a) To modify a license to allow a license holder to carry a handgun of a different category than the license indicates, the license holder must:

(1)

complete a proficiency examination as provided by Section 411.188(e); and

(2)

submit to the department:

(A)

an application for a modified license on a form provided by the department;

(B)

evidence of handgun proficiency, in the form and manner required by the department;

(C)

payment of a modified license fee of $25; and

(D)

one or more photographs of the license holder that meet the requirements of the department.

(b)

The director by rule shall adopt a modified license application form requiring an update of the information on the original completed application.

(c)

The department may modify the license of a license holder who meets all the eligibility requirements and submits all the modification materials. Not later than the 45th day after receipt of the modification materials, the department shall issue the modified license or notify the license holder in writing that the modified license application was denied.

(d)

On receipt of a modified license, the license holder shall return the previously issued license to the department.

(e)

A license holder whose application fee for a modified license under this section is dishonored or reversed may reapply for a modified license at any time, provided the application fee and a dishonored payment charge of $25 is paid by cashier's check or money order made payable to the "Texas Department of Public Safety."

Modified license has a specific meaning in the CHL law. It's not what many people think. Like they said, it's right there in the CHL~16 document, including the section quoted.

This was covered in the Instructor's course, what we were told was that if it was a renewal license (the old license no longer being a valid license) you were free to keep/destroy the license. But if it were a replacement/duplicate license you should send in the old license that would appear to still be valid.

The OP is free to do as he chooses. Myself, I wouldn't risk it over a few cents worth of postage. I'd probably spend the few bucks to send it return reciept requested.

People can choose to play it safe by notgoing into businesses with a gun buster sign, but that's not valid 30.06 notice. it's the same for an address change and a modified license. It's fine to encourage caution as a personal choice but lets not "living document" the actual written law.

I'm passing out information given me directly from DPS, Not "living doucment"ing anything. Again the OP is free to do as he chooses.

Updated: I did follow up with a call to DPS and according to Darrel the OP is free to destroy the old license.

Same (year and everything). I didn't mail mine in, just destroyed it. Haven't gotten a letter about my license being suspended for following their instructions in the past two years, so I guess I'm okay.

Same here early last year. I called DPS and they told me to just destroy the old one. No problems.

If all you did was change your address you DO NOT have to send the old one back.

There is only one definition of a Modified License.
That is when a person that qualified w/ a revolver decides he/she wants to carry a semi-auto. He requalifies w/ a semi-auto so the State "modifies" the license from NSA to SA. That is the old one that is required to be sent back.

Your old one w/ the old address is now an invalid CHL because it is for an incorrect address.

If you choose to send your old one back they will throw it away for you but you are not required to.

I was told differently before. I admit when I'm wrong.
