Ok, so I know I have to go to the Tarrant County Court to get a Final Judgement and Sentance for a Class A Misdemeanor from 1991 that was Deferred Adjudicated.
1. What do I need and where do I get it, for a municipal Disorderly Conduct ticket from Ft. Worth, in 1988? I believe this falls under 411.174(b)(7) " criminal history record information of the type maintained by the department under this chapter, including a list of offenses for which the applicant was arrested, charged, or under an information or indictment and the disposition of the offenses; and"
2. I had another Class A arrest 1995 that was never prosecuted and in 2003 the arrest was expunged by court order. FWPD arrest and Tarrant County after. The law talks about expungement as it relates to convictions but not arrests. I don't have a problem listing it on my application, but what can I provide if there are no records?
Nothing is disqualifing because of the time, but I want to do this once and correctly.

Honestly, I do not really see anything in the law about supporting documentation, only full disclosure. Can't they go on their own database/website and find out this info? That is where I can find info on the 91 arrest.

This is pure speculation, but obviously DPS can look up your record. That's what they do when they do a background check. I suspect what they're doing is seeing how honest the applicant is. If you're above board and list everything, no problemo. But if you leave out something, that's suspicious.

Get documentation from the courts where the arrests occured on the disposition of each. If they say no records exisit, then get a document saying as much from them. DPS will require this and they can deny your CHL if they don't get the paperwork they request.

You'd need to check with the municipal court, 1000 Throckmorton, in downtown FW. But, I'd call, first, to see exactly who, in that maze, you'd need to see. They should be able to research, based on the citation number, everything you need for DPS.Bandit19D wrote:

Ok, this is for others. I called both the FW Municipal Court and the Tarrant County # above (Thank so much for that #, I had a bunch of other numbers, but that one worked perfect). Had to fax in the request to the FW Municipal Court. Have to see how long that takes. I will head down to the County Criminal Court Monday morning, hopefully it won't take too long.
I also called DPS, 50 Min wait for a rep, basically I think they just want something from the County and City mainly to see that there is nothing currently disqualifying, even if it says their records have nothing.
