Holder Threatens Kansas Over New Gun Law

Post by gthaustex »

Interesting read. The feds didn't waste any time asserting their authority....
Kansas Governor Sam Brownback received a letter today from Attorney General Eric Holder threatening action against the state should it enforce SB102, the pro 2nd Amendment law Brownback signed into law last month.
The new law declares that the federal government has no power to regulate guns manufactured, sold and kept only in Kansas.

Any act, law, treaty, order, rule or regulation of the government of the United States which violates the second amendment to the constitution of the United States is null, void and unenforceable in the state of Kansas.
The legislation made it a felony for a federal agent to enforce any law, regulation, order or treaty regulating ammunition made, sold and kept in the state because the federal government does not “interstate commerce” authority over such items.

Kansas isn't the first state to do this. Has he made similar threats against the others?

Not that I have heard of. That is why I found this interesting. Almost immediately after it was passed / signed, the feds fired off a letter. Then again, perhaps they have warned other states and those states decided it wasn't worth publicizing.

Instead of a mere felony, Kansas LEO should treat a fud trying to enforce unconstitutional laws as an enemy combatant.

Or maybe that's what the local citizenry should do. Redcoats is redcoats. :patriot:

A well written, concise letter that lays it all out. Good job by the Kansas AG, including pointing out the hypocrisy of the current administration in picking and choosing what to enforce.

Kansas's last governor is Kathleen Sebelius, a hardline leftist, and current member of Obama's cabinet (Heal & Human Services). My guess is that this new law passed over some stiff opposition from the same folks that elected her governor, meaning that the forces of Mordor still have a significant presence in the state. If Oklahoma or Texas were to pass such a bill, I doubt that Holder would waste time trying to send them a letter which he knows full well will just end up burned in an ashtray. Maybe he thinks Kansans will back his play.

I almost hope Holder tries... The courts would essentially be forced to decide what constitutes "interstate commerce", which will either solve a lot of our problems or lay the legal framework for the continued destruction of the country, depending on which way they rule.

The thing is, the Constitution gives Congress the power to regulate interstate commerce. Constitutionally, the administration only has the power to administer the regulations passed by Congress......which is what is so troubling about the abuse of "executive orders." The president, technically, may not enforce a regulation that Congress has not deemed to exist.....not that every dumb bunny....'scuse me, I mean democrat in Congress wouldn't be perfectly content to roll over for Obama and give him whatever he wishes for.

I don't think Eric Holder is too worried about Kansas right now, I believe he maybe more concerned about keeping his freedom or possibly his job. Or should that be the other way around?
Of coarse a lawsuit would be interestin'.
