Background Check "Delayed" on Gun Purchase

I had a student attempt to purchase a pistol at a gun show today and the background check came back "delayed". He asked me what sort of things might cause this. He confided that he is in a long standing dispute with the NTTA over unpaid toll charges ($70.00), which he has proof he has paid...but has not gotten their record cleared yet. They inform him that there is a warrant out for him in Dallas County.

He cleared the check for the CHL with no issues, at least none that he was informed of, and did get his license.

I told him that this warrant might possibly have flagged the background check they did at the gun show, but I would try to find out any other possible reasons. Was I correct? Anyone had a similar situation regarding traffic violations?

First, he needs to get that warrant taken care of, because that can cause a lot of problems in the future. Use that proof and submit it to collections, or whatever it is, by certified mail. Since the warrant has already been issued, I'd recommend a lawyer get involved.

Second, why did the dealer do a NICS background check if he had his CHL? All he has to do is fill out the 4473 form. I would always tell the dealer that no phone call is needed because I have a CHL. If they insist, leave for a competitor.

One can never assume any rhyme, reason, or logic to a NICS delay, and it isn't worth the mental energy to try and second guess it. It can be as simple as a person with a similar name, different birthdate, living 8 states away. The system is notorious for false delays.

I've also read of reports where anti-gunners working at NICS are literally bragging about all the false delays they can cause using the flimsiest of excuses.

We usually want to personalize it and wonder, "what did I do wrong?" The reality usually has nothing to do with us personally and is instead stemming from a hostile and out-of-control federal bureaucracy. All we need to do is look at their overbearing jack-booted thug bureaucracies at the F-Troop and the IRS to realize the species we are dealing with.

I don't see a 75 toll warrant being the cause. Those won't even show up when you run a warrant check. Probably something else.

No, as a matter of fact he has a very uncommon full legal name. The word he got was that it was currently "delayed". If the "delay" was not changed to a "deny" by end of business Wed., he could pick the gun up on Thursday. Something about they have 3 working days to review???

Now I am beginning to remember why I gave up my FFL years ago.

Common or uncommon name, it does not seem to matter anymore. I am getting more frequent delays for people that have never been delayed in the past. There seems to be no rhyme or reason to it so do not even try to figure out why. The good thing is they are not "denied", get a CHL and only go to dealers that will not run the NICS since it is not necessary.

Same here. This is one of the major reasons why I give $10 off for transfers if you have a CHL -- less headache for BOTH of us! I hate delays. My customers hate delays. Get your CHL and then do business with CHL-friendly dealers (i.e., NOT Academy).

The only "rhyme or reason" that fits, imo, is we have the most gun-hostile administration in history.

Bought a Taurus 9mm today at Academy. Very friendly and professional, No NICS call. They also keep ammo in back stock for customers who purchase a firearm, so I also bought 3 boxes of Monarch for $12.99 a box.
