Mark O'Mara calls prosecutors 'disgrace' to profession

Post by baldeagle »

George Zimmerman's chief defense lawyer on Monday called Florida prosecutors "a disgrace to my profession" for holding back evidence for months and pledged a new effort to impose sanctions against them.

Good. I hope they are disbarred.

In previous job I was involved with lots of civil litigation. Lawyers always plays lots of games with each other, and it is from both sides. Don't really see a big problem with that. Personal take is that they were doing the best they could with a case they were mandated to pursue but did not really believe in.

Prosecutors are under a special obligation to disclose all information in their possession to the defense, no holding back stuff especially if it is conceivably beneficial to the defense. Games are played but cheaters get caught and punished, sometimes severely. If there was really beneficial info that they alone had and did not disclose, there are in real trouble.

This whole thing kind of smells funny since apparently the normal prosecutor declined to file, whereupon they brought in a designator hitter. It happens that prudent, ethical experienced attorneys can disagree about the strength of a set of facts, I suppose, but it isn't usual.
Luckily, I have enough willpower to control the driving ambition that rages within me.

Its not right either way but civil isn't going to put someone in jail for years. For this case everything should have been upfront to ensure there would be no issues with the result. I do understand that there are people that were going to be unhappy no matter what happen.

The prosecutor needs to pay the penalty as they have already fired people. Just my opinion :tiphat:

Corey responded that O'Mara's comments were unprofessional
As opposed to her comments on TV that Zimmerman was a murderer, right?

Factually correct but unprofessional?

NEW YORK (Reuters) - A former employee of Florida State Attorney Angela Corey's office plans to file a whistleblower lawsuit against George Zimmerman's prosecutors, his attorney told Reuters on Tuesday.
Ben Kruidbos, Corey's former director of information technology, was fired after testifying at a pre-trial hearing on June 6 that prosecutors failed to turn over potentially embarrassing evidence extracted from Martin's cell phone to the defense, as required by evidence-sharing laws.

Beat me to asking why isn't he covered under a whistleblower protection...
