Past DWI

Post by Thatguy1103 »

So I had a CHL but had it revoked when I got a DWI, I had a second which was pled out to the same as a first offense. Am I messed up as far as getting another CHL even though its been 5 years since I had any trouble? The DPS Wesite is noncommital and I would have to take the class and pay all the fees to find out if I can get a CHL and don't want to waste the time or money if its a lost cause.

Thanks,

You may not be eligible. Government Code GC §411.172. ELIGIBILITY states:
(c) An individual who has been convicted two times within the 10-year period preceding the date on which the person applies for a license of an offense of the grade of Class B misdemeanor or greater that involves the use of alcohol or a controlled substance as a statutory element of the offense is a chemically dependent person for purposes of this section and is not qualified to receive a license under this subchapter. This subsection does not preclude the disqualification of an individual for being a chemically dependent person if other evidence exists to show that the person is a chemically dependent person.
So, if your two DWI's were both within the past 10 years, then you will have to wait until one is over 10 years old. Then, you will have to wait 7 years, (5 years, plus 2 more) since your license was suspended, past the conviction date on your last DWI to be potentially eligible.

So, it will all depend on your conviction dates and how long past those you are.
