CO gun laws and an Attorney recommendation

Post by cprems »

Guys/gals,

A friend needs good Counsel to fight a summons.

I have a friend in CO who was summoned to Court for a misdemeanor "concealed" carry of an unloaded hand gun. CRS 18-13-105 (i)(b) Unlawfully carrying a concealed weapon is what was on the summons.

The officer found the gun in plain view in his car.

Long story short - car full of drunks landed in a ditch and he stopped to help. The car load of drunks got belligerent and were throwing gang signs at him. he got out and put the gun in his waistband. One of them claimed to see a gun on him and he was arrested. While in the PD, the drunk guy then attacked him and it was all caught on tape. The PD is willing to give him the video and told him to fight the charge. The weapon in question was found in his vehicle, unloaded and no ammunition with the weapon. The witnesses to this all gave conflicting statements and this is why he was released with a summons to appear.

He is located in the south central CO.

The PD has told him to get a lawyer and fight this.

ANy help appreciated. This guy just got out of the Military and his father is a disabled war veteran. I am trying to help them out.

Why did he put an unloaded gun in his waistband?

That seems to me a less important question at the moment than answering where he might get good legal representation. Plenty of time for recriminations afterward.....
