"A University of Virginia student, alleging assault and malicious prosecution, filed a $40 million lawsuit against the state over being arrested and jailed after buying a case of sparkling water. Elizabeth Daly spent night behind bars after Virginia authorities jumped on her car, flashed a gun, tried to break window believing the 20-year-old had illegally bought beer. The UVA student had purchased case of sparkling water."

wow, i don't know about 40 million, but definitely deserves a nice check for her troubles.

IANAL so this is just my opinion. I agree that she should sue and win damages.
Shouldn't those who actually did the deed pay and not the taxpayers?
If the thugs committing these acts have no skin in the game, where is the motivation to stop?

You would think the tax payers would get fed up and demand real change. I agree the agents involved should have skin in the game. I also think it is incumbent upon us citizens to put pressure on our public servants to stop the overzealous thug tactics and make sure the agents and officers are properly trained and held accountable.
Like I said before, this kind of policing has to stop. If not, it will continue to degrade our freedoms until things get ugly.

It did say the officers were named in the lawsuit. However, I assume the State of Virginia will have to hire separate lawyers to defend each of them in court and pay their fees. Its good to be an attorney.

I think it should be both the city and the individuals. The city sets policies, procedures, and training standards so if these guys acted on their training of policies the city is at fault. But at the same time, if they are found to be in the wrong and went beyond their training or the scope of the policies and procedures then they should also pay out of their own pockets.
I do not care for the increase of commando cops. Our county just got a tactical team for the Sheriff's Department and the reasoning behind it was to combat drugs, and they could be useful in executing warrants. When asked how many times constables have been attacked while serving warrants in the past in the county the answer was "zero - but one would be too many". My view is different, they get paid to do a dangerous job so they need to accept that there may be danger. One homeowner killed by a tactical team serving a warrant on the wrong house would be one too many.

Most likely not - the state will have to provide for an attorney, but it's likely to be the same state's attorney that is defending the state, itself. When I was in the service my government insurance was 25K if I got killed in Nam. When one sues for 40 mil I think one just kills their case. They may have a good case but the laugh at 40 mil just makes it a loser.
