In the document read to the court Judge Kelly concluded although the child now appeared to be “happy and healthy” he acknowledged it was “hard to gauge” how the crime might affect her later in life.
He also noted that a court-ordered psychological examination concluded Rojano-Nieto was not a true paedophile, and a sentencing report claimed he did not pose a danger to society.
"Although serious and despicable, this does not compare to a situation where a paedophilic child predator preys on an innocent child," the judge added. "There was no violence or callous disregard for (the victim's) well-being."

The pedophile should get 25 years. The judge should get life.

He didn't put his hand over her mouth because he thought he was doing something kind. If the judge thinks this is a nonviolent crime or that it didn't involve callous disregard for the victim's well being the judge is a prime candidate for a checkup from the neckup.
I would also be absolutely astonished if someone who so rapidly took advantage of a chance encounter and acted to conceal his actions was a first time offender. This might have been the first time he was caught but I'd put money on the idea that it wasn't his first go around with that type of crime.

Unbelievable. The forum rules won't let me post my visceral reaction to this. As an adoptive father of three children who suffered abuse at the hands of other adults, I can almost ensure you that little girl will be mentally traumatized for the rest of her life. It is well documented that children who are abused even at the youngest of ages exhibit PTSD like symptoms and worse later in life. This judge hasn't a clue. Where was the child's advocate in this case??? That animal should never see the light of day again.

If that were my child or my grandchild the pedophile would not have been able to stand trial. Two heinous acts. I hope the Judge is disbarred and the pedophile receives his Jailhouse Justice soon.

Perhaps someone could make sure his crime is known inside the walls. He will probably be in segregation or with like offenders for his own protection until he gets out.
in societies that have restrictions on guns, their concept of justice is might makes right. Guns are the great equalizer. Guns protect the weak and old. As a small matter of personal consequence I remember the day I lost my confidence in the judicial system . It was the day the court did not execute Jeffery Dahmer . It took hardened criminals to get it done . A man should not be allowed to torture , kill and eat his neighbors .
What if it were the judge's own child or grandchild? I am appalled and angry by this judge's decision. If he were our local judge, I'd start a petition to remove him. They should name and shame this judge!
