I need to know how I can get in touch with someone representing the state to start paying on a student loan before I mail my stuff off. Turns out I have a problem with a private college drawing $10,000 on a student loan when they were not supposed to, and when I found out about it they said they would get in touch with me, and then the school closed a few days later and I'm left with no way to contact them. Either way, I'm about to sue the living crap out of them, but until then, I would like to pay on my loan to show that I'm co-operating with the state. This loan has been in default for almost 2 years, and I have never received a letter from the school or the state informing me that the debt even existed. I had to run my credit to find out about it.

Defaulting on a student loan is a problem only if it is a state-guaranteed loan and you have been found "finally" in default. The exact wording of the law is "has not been finally determined to be in default on a loan made under Chapter 57, Education Code." [GC §411.172(a)(12)]

As usual, I am not a lawyer and have never been involved with this kind of business, but it seems to me that you could not be found finally in default without being served with legal process or at least getting a lot of mail.

I believe it is a state guaranteed loan,but again, I never received any information on it so I guess I'll have to look farther into it. Thank you for the information.
