The above link is to a Vanity FAir article about the medical student from Boston University
that is known as the Craigslist killer.

This piece is 5 pages long and will take you a little while to read, but it explains the whole
case.

He was a NYS resident living in Mass. while attending school. 2 tough states for handgun
purchases. The way he got his Springfield XD9 is he used someone else's NYS ID to buy the
gun in New Hampshire, which is more 2A-friendly than either NY or Mass.

Hopefully the gun store in NH won't get in trouble for selling the murder weapon to him.
He shot the young woman 3 times: heart, chest, and stomach.

If a FFL in New Hampshire knowingly sold a handgun to a New York resident who presented a New York ID, they should be prosecuted. But I wonder at the truth behind the story because a gun store has to run the sale through the national Brady check. And I can't imagine the feds giving the OK for a NH FFL to sell a handgun to a NY resident. Something doesn't add up.

Why would the FFL be in trouble? Federal, laws actually allow purchases in other states with proper ID as long as the states have passed their own laws allowing such purchases. You could have gone to LA this weekend and purchased long guns with no sales tax, but not handguns because TX has not passed a law allowing it.

Of course in this case there would not be proper ID, but that makes it a criminal act on the part of someone who is determined to violate the law anyway.

Is there some law that says a person who owns a gun has to be legal to possess it in their home jurisdiction? Don't tell that to Heller.

handgun transfers must go through an FFL in the buyers state. He could purchase the weapon out of state but to be legal the weapon must be transfered though an ffl in the state he resides in. The law allows the purchase and transfer of long guns out of state (and thank God Texas has finally caught up with that) from an FFL.

"Vanity Fair"? That's nothing but a high dollar gossip mag. "People" for the rich and famous. I doubt the editorial integrity of either. The objectivity of the story is well let's say suspect at best.

If the FFL did break the law shame on him.

The ATF says different. They think you can only buy handguns in your own state.
(B2) From whom may an unlicensed person acquire a firearm under the GCA? [Back]

A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee's premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

Well, you may not like that mag but that's where I found the article. Anything you read anywhere can be incorrect,
but this link contained more about this story than I have seen anywhere else.

Regarding the New Hampster FFL selling a pistol to a NYS native who was living in Mass, but may or may not have
established Mass resident status, and using someone else's NYS ID, we certainly don't have enough information to
really know if this transaction was legal or hinky. We don't know if the NH seller transferred the gun to a Mass FFL,
or if the future murderer walked out the door with it.

I didn't think the author of the article showed any particular prejudice regarding the gun. He reported about the
murderer in a rather straightforward manner.
