An interesting case of probable cause - drug possession

On October 3, Galveston police raided a bar at 41st and Broadway. (You could not drag me into this place chained to a Ford F-350 with cowboy duals.)

The raid was conducted to search for a woman who had outstanding warrants. When officers entered the bar around midnight, they reportedly told everyone present to put their hands in the air. When the lights were turned on, a packet of cocaine was found on the floor. The police charged the woman closest to it with felony possession. Three other people where charged with drug possession and two with public intoxication.

Yesterday, the DA announced that he would not accept charges against the woman who was found near the contraband, as there was no evidence that she had dropped it.

BTW, the accused woman got a first-class defense attorney, Joel Bennett.

Two guys were charged with public intoxication in a bar? So is any place outside your home considered a public place, where you could be charged with this?

It is illegal to be drunk in any public place or private property that is open to the public. You could be drunk in your own home or someone else's, or a hotel room. I don't know about private clubs. I think they have the same rules as bars.

If I wanted to disassociate myself from a packet of cocaine, I'd sling it as far as I could. Like over by a black lady in a Galveston nightclub who's GWTCA (guilty when the cops arrive).

The woman who was arrested was white.

I think the clientele in that bar is mostly Mexican, but I'll never know for sure.
