VA: Man found not guilty for shooting fleeing burglar

In Danville, Virginia (Georgia border), a jury found a man not guilty of murder and a felony weapon violation for fatally shooting a burglar who had fled the home.
[The defendant] testified Tuesday that he didn’t realize [the burglar] was the person who broke into his apartment on Sept. 18 until after he shot him.

“I thought he had a weapon,” [the defendant] said. “I thought he was going to shoot me. I wouldn’t have shot if I knew it was Alex. I might have been mad, but I wouldn’t have shot him. I wouldn’t have shot Alex.”
