Right! Does not look good. My CHL instructor stressed de-escalation, negotiation, and escape. I would like to think that I would handle such a situation differently. It will be interesting to see how the grand jury treats this one. Thanks for the post.

Not good, no way the gun should have even been introduced into the situation it sounds like. Even if the guy was fleeing the scene, deadly force is not justified from what it looks like.

The CHLer was claiming that the driver was fleeing the scene and did not want the police to be called in (standard procedure) for that no need to hold the driver or even pull a weapon. However, the CHLer also claimed the driver tried to run him over (most likely bump him when pulling out). If the CHLer intended to call the police why the other driver did not wait for his wife? was he afraid to pay a fine or not pay for the damages? Regardless fleeing the scene was bad idea. Also after the shooting the shooter was cooperating with the 911 even before they arrived on the scene.

Is this one not reason why we have unisured drive in our insurance. He could have wrote down plate number called police and reported it as hit and run. Or followed from a safe distance with police on phone , so many things that could have been done besides pulling a gun.

Yes this looks questionable, bad even. And no, I wouldn't have likely handled the situation this way.

But this is still basically a he said/he said situation.

Based solely on info in this news story, seems the lynchpin is whether the shooter truly BELIEVED his life was in imminent danger. Not sure police on scene can make that determination based solely on statements and reported position of shooter and other man's car.

This is what trials are for. And also what defense attorneys are for. Hopefully this guy has a good one.

good thing I have uninsured motorist insurance and as mentioned, I would have repeated the lic plate 3 times and asked my wife to relay it to 911.

He knew it, he just knew one day driving from the country where them city folk my get em', he would get into a fender bender and have to defend his honor and life from a 32 year old married man trying to drive off for some unspecified reason.

Like you, I have high doubts about whether he truly believed his life to be in danger (doubtful) or if he got caught up in the heat of a hit/run situation (more likley). Most likely his sign is just as you call it. However, please don't disparage those of us who may consider ourselves country folk.

Traffic, road rage, Austin traffic, and a CHL have not mixed well lately. This is the second incident in just a few months. Neither one looks very good for the CHL holder.
